I can't help but think it would have been easier for Romney to come out and say he stopped actively participating in the management of Bain in 1999, though he remained the titular CEO until they found a successor in 2002.

While conceding that Mr. Romney "legally" remained the firm's chief executive, Mr. Conard said he did not remember Mr. Romney's taking part in any meetings.



"I can't recall" is not a definite no. weasel words lawyers used to mislead and stay out of legal trouble.

He's running from Bain's acquisition of Stericycle stock in November 1999.

According to John King's article entitled "John King: Why is 1999 so important in 2012?":


And inside both Bain and the Romney campaign, there is a strong belief that either the Obama campaign or a Democratic ally wants to use another Bain investment against Romney late in the campaign but cannot do so with any credibility under the February 1999 departure scenario.

The investment in question: Stericycle, a medical waste company that, among other things, disposed of aborted fetuses.


How could the Stericycle investment be used against Romney?


Bain's involvement in a company that disposed of aborted fetuses could make a powerful final week direct mail piece or attack ad on Christian radio. And in a close election, turnout of the religious right is one of the keys to a Romney victory in November. (emphasis mine)



Romney has reason to be worried.  In fact, he should be very worried.

You see, if the Grey Global Group stock acquisition SEC filings were fairly easy for me to find...


...so were the Stericycle stock acquisition SEC filings on November 22, 1999.  And they're a doozy.


First and foremost, Bain didn't aquire Stericycle.   Brookside Capital Partners Fund did, and David Corn has already outlined W. Mitt Romney's role in Brookside, as well as its relationship with Bain Capital, in "EXCLUSIVE: Romney Invested Millions in Chinese Firm That Profited on US Outsourcing".  Brookside is a subsidiary of Bain Capital.


Moreover, Bain Capital was, in fact, also directly part of the acquisition of Stericycle stock.


More importantly, this SEC filing represents W. Mitt Romney as "the sole shareholder, Chairman, Chief Executive Officer and President of BCI, BCP VI Inc., Brookside Inc. and Sankaty Ltd" (emphasis mine).  That pretty much speaks for itself--he's not only the chair, CEO, and president of Brookside, but also Bain Capital Investments ("BCI") and other the other Bain parties involved in the acquisition.  This kind of declaration is repeated over and over throughout the document.


Moreover, unlike many of the other SEC filings, including the SEC filings for the acquisition of Global-Tech Appliances that David Corn exposed three days ago, W. Mitt Romney actually signed this one:

This is not merely some document formed by Brookside and signed on Romney's behalf by Dominic Ferrante, like the acquisition of the Grey Global Group stock or the Global-Tech Appliances stock were.

Mitt should just stand up and admit to running Bain. Just say that they were a business and their business was making money. Sometimes they bought companies that were in bad enough shape that the only way to make them profitable was to switch to cheaper foriegn labor. Then spin that into a spiel about how reducing regulations and government oppression will make the US a more business friendly land. Sell it not as shipping jobs overseas but instead as saving as many as you, or anyone possibly could have.

Pin the blame on Big Brother and move on, because absolutely no one is buying that you got paid $100,000 a year and told the SEC you were the big dick while at the same time having no idea or control of what was going on.

And the truly amazing thing is that in this case, all Trollbama had to do was just ask questions! He never said Rmoney had committed a felony by lying on official SEC documents, he was just wondering out loud about the whole thing.

Whether or not he lied is far from the most interesting aspect of this story.

It's the fact that Romney is actively trying to distance himself from his past as a corporate parasite as much as possible. He and his election team clearly understand that the longer Obama hammers him about his history of gutting American jobs, the more likely it is that he'll lose. Something tells me that this is just the beginning of a long line of farked up shiat that Romney has hidden.

It's strangely amusing because if there's one thing I'm sure of, it's that ole Mitt doesn't like being called out on his sociopathic behavior; especially by those contemptible middle class peons that he's supposed to be in charge of. Well, since President Obama is losing big-time to Romney in fundraising and super-big-money donors to SuperPAC's are trying to pretty much outright buy the Presidency, he has to show no mercy politically if he wants to get re-elected.

Any dirt he can get on Romney, he'll use. If Rmoney actually did screw up and do something that was technically a felony a decade ago, he'll use that for everything he's worth.

This election is going to be about can you outright buy the Presidency if you have enough money, even though you're deeply, seriously flawed as a candidate with a number of skeletons in your closet.

Hey, he made the trains run on time - Romney excels at achieving his business objectives. Whether it's bailing out the winter olympics or extracting all possible value from a viable, productive business then firing all the workers, he doesn't let pesky things like morals or ethics - or even, you know, objective reality - get in the way.

If the recall elections in WI told us anything, it's that you can buy an election. I don't remember where, but I read that the total spent, including candidates and interest groups, topped $83 million, most of which was in a span of about 6 weeks and was spent on attack ads.

...so were the Stericycle stock acquisition SEC filings on November 22, 1999.  And they're a doozy.
First and foremost, Bain didn't aquire Stericycle.   Brookside Capital Partners Fund did, and David Corn has already outlined W. Mitt Romney's role in Brookside, as well as its relationship with Bain Capital, in "EXCLUSIVE: Romney Invested Millions in Chinese Firm That Profited on US Outsourcing".  Brookside is a subsidiary of Bain Capital.
Moreover, Bain Capital was, in fact, also directly part of the acquisition of Stericycle stock.
More importantly, this SEC filing represents W. Mitt Romney as "the sole shareholder, Chairman, Chief Executive Officer and President of BCI, BCP VI Inc., Brookside Inc. and Sankaty Ltd" (emphasis mine).  That pretty much speaks for itself--he's not only the chair, CEO, and president of Brookside, but also Bain Capital Investments ("BCI") and other the other Bain parties involved in the acqu ...


He's running from every subsidiary of Bain he's the sole owner of. His tax returns would open a Pandora's box of each company, and the money flowing through them.

Thinking about it, he's technically correct. He's not been convicted, and if I follow the given details right, the statute of limitations has expired. So he's not a felon, but he hasn't denied having committed a felony.

And really, any of you who count conservatives among your friends know one thing for sure. Most GOP supporters are essentially holding their noses and pulling the lever for Romney at the end of the day. Thinking about it, he's technically correct. He's not been convicted, and if I follow the given details right, the statute of limitations has expired. So he's not a felon, but he hasn't denied having committed a felony.

It depends on what you get away with. If he punched a baby, for example, did the baby have it coming? Was it being a dick?

He could get away with it if people understand just what happened in the first place. If it's too complicated and won't fit in a sound byte, they may not care. "Don't vote for the baby puncher" is a lot easier to understand than "Don't vote for the guy who made some kind of statement to the SEC that..." and so on. If you can get what he did onto a bumper sticker, then it's an issue.

But if there's one thing South Park has taught me over the years, is even the numbskulls that vote Republican understand "they took our jerbs!" - Obama just has to play this up and casually mention that he killed the shiat out of Bin Laden and things should fall his way. Not to mention the Republicans have been trying to dial back the crazy after Palin lost them the Senate. That's the real reason Romney was chosen to win: he was a moderate that could (in theory) compete with Obama while throwing some red meat to the Base Tards. The Republicans are trying to backtrack from their Base's insanity and finding themselves unable to do so. This isn't a defense, but another reason why they had to back Romney. I'm as liberal as they come, but I do kind of see what the Romney campaign means by using the phrase "retroactively retired". Romney left Bain in a hurry to work for the SLC Olympics, then decided not to come back. He made a crapload of money while he was "retired", but it probably wasn't beyond what he would have gotten as a severance package, given how crazy those get for executives. When he decided to not come back to Bain, they decided to backdate his retirement to 1999. His campaign is currently handling this stupidly, but I can kind of understand how it happened.

What is actually more scandalous to me is that if you believe the above, he lied to the Massachusetts Election Commission. There, he said that his leave of Bain was always intended to be temporary in a hearing about his residency prior to the gubernatorial race. That said, the Obama campaign has decided that this story has more legs, because it focuses on Bain rather than a nuance of state election law.

Well congrats to Mittens. He is officially running the most inept presidential campaign I've ever seen from an actual nominee.

And what's funny is Rupert Murdoch was recently saying that Romney needs to fire his staff and surround himself with real pros if he wants a chance at beating Obama. The writing is on the wall all over this one.

My guess is there will be a big shake up in the Romney campaign under pressure from his big money benefactors. They can't be happy with the way Romney is running his campaign and by God they have to get a return on their investment.

Not to mention the Republicans have been trying to dial back the crazy after Palin lost them the Senate. That's the real reason Romney was chosen to win: he was a moderate that could (in theory) compete with Obama while throwing some red meat to the Base Tards. The Republicans are trying to backtrack from their Base's insanity and finding themselves unable to do so. This isn't a defense, but another reason why they had to back Romney. He was their only chance, and he was just as big a retard as the rest.


The thing is, they had the opportunity with either Huntsman or Johnson to dial it back. Both, proven leaders, albeit without the soft and malleable streak that Romney has. Romney is a go to guy for contracts. He also has a certain "moral flexibility" that plays well to the Kleptocrat set, but zero charisma, and zero integrity--which should have been something to tip them off a while ago. Instead, they wanted someone who would be entirely controllable. This Quayle 3.0. GW was the 2.0 version, and look where it got the country.

It's this endorsement of ethical vacuum while trying to drape oneself with the flag and moral platitudes that got us into the financial mess that we found ourselves in at the end of GW's term. For all the posturing, it is about cash money, plain and simple. Who will deliver it, and with a smile on their face.

Huntsman and Johnson are both proven leaders, and the folks who are at the heart of things genuinely fear that. They want someone who will tow whatever line is dangled before their boy, and nothing but. The problem is, My Pet Goat pretty much proved what that will get us when what amounts to a sock puppet is put into the Presidency, and no one wants to admit that.

There are folks in the Republican Party that are worth watching, but the Eat Our Own/Lockstep Vision thing has reduced the Big Tent down to kleptcrats and folks even the Moral Majority would find extreme, and there is little else that the leadership wants--because anyone else might do something unthinkable: lead.

This has been my problem with the party for some time. I voted against such sock puppets, but the rank and file is determined to be cats, looking at the finger, instead of the food like confused cats. My last vote in the Primary was an attempt to derail that, but the rank and file is buying the bullsh*t, and if that is what the leadership wants, then they're welcome to it.

We need leaders. We need folks who actually have vision, not just talking points and memos handed to them of what their policy should be this week.

This mess? This is the result of years of dumbing down the debate, and advancing folks who will give until it hurts to get along. Romney is an ethically and morally bankrupt human, and I kenned to that back in college. BEFORE he headed to the Olympics and Utah. This is not something that just ballooned up from left field--folks have been backing and grooming this cat for a long while, because he has no real ideas of his own, save to line his own pockets, and to line the nests of those who will give him what he wants.

He is the candidate the party deserves. He just isn't the candidate that the party needs, or the country for that matter. Palin wasn't the problem with the party, she was a symptom. Idiots promoted and advanced up the line, because they said the right things, and signed what was put in front of them when their handlers said to, and to spout points that they couldn't defend, because they didn't even understand the questions before them, and just were reading off the cue cards.

Rove and his ilk did the party a grave disservice for a long while. And the country for that matter.

I was glad to support McCain in 2000, because I genuinely thought he was the best man on the field for the party. And he was torn to shreds on that campaign by members of his own party to advance Quayle 2.0, and we've seen the results. Romney is at least aware of his culpability, but he doesn't care that he'd be a sock puppet, because he wants the prestige. The office? He doesn't care about that. He just wants to put his feet up and let the piggies feed out of the trough, and then coast for the next 10 years on the grateful handouts, the book tours, and attend affairs of state, and collect applause. The job? He couldn't care less about, because it's not about the office, it's not about the people, it's about the payout at the end.

Which is why I for damn sure couldn't vote for him. Will never vote for him, because the party and the nation need better. And maybe, just maybe, if we rip these asshats a new one, we can shred their influence. The party is sick. Gravely ill, and folks are looking to hookum and laying of hands to mend it, and the party needs more than faith healing. It doesn't need a purge. It needs folks to wake the f*ck up. That isn't going to happen if we keep rewarding folks for showing up. For not taking responsibility. The party, in order to get better, is going to need folks to demand better.

Not pretty words. Not glad handing and back patting, but actual leadership that is going to do more than manage problems, and actually look to solve them. That means real work. That means real scholarship--not studies commissioned to reinforce positions already decided upon because folks are invested in them. That means voting for folks who actually give a rat's ass about the country, and not just their next payday or who gives them a treat and smiles pretty for them.

We need a real party, as opposed to this sham that we have, and I probably stayed in longer than I should have, but I thought we could turn it around. And when I saw that I couldn't, I got out. Not because I had changed. Not because I was less Conservative, but because I can't stand to see what the party has done to good people, to fall to radicals with visions that have little to do with the values I grew up on. The party is sick, and the sad fact is, there are a lot of folks who would rather point fingers, than vote for folks that they think will do a good job, because they feel that it's a team sport.

You want a better Republican Party? Then vote for folks who actually care about the Republic. You want a better nation? Then vote for people who actually care about it, no matter the party. We can't afford more of the same tired bullsh*t. Voodoo Economics doesn't work. We tried it. We ballooned our debt to the point where we don't even talk about it, just how much we can't pay this year. THAT is an issue. You want fiscal responsibility? Then vote for it, and right now, that means real solutions, not catch phrases and "no new tax" pledges written by a 13 year old who couldn't get his right hand to work his peen properly so he wrote a screed to cover his own inadequacies, not some aging beauty queen who hasn't had an idea that wasn't handed to her to sign, not some idiot who thinks that demonizing your sisters and daughters for daring to want control of their own bodies, not some closet cases who can't admit their own urges and who want to tear apart the thought of the 1st Amendment to hide that to deny our brothers and sisters equal rights. We need better, and kids, Romney ain't it. He never has been, and it will probably take getting spanked, again before the Idiot Brigade realizes that they've been played by folks looking to pocket as much of their cash as possible. And if that is what it takes, then so be it.

Which is the point. This isn't a team sport, and if a Democrat or Republican is the better candidate, you need to vote for the better candidate, not just the right letter. Which thinking people usually do, but at this point, we are far down the Rabbit Hole, and mouth breathers who have access to Wikipedia and a whole raft of pre-drawn talking points to draw on for arguments are thinking that their abdication of anything like critical thinking skills is a plus because they're pure...

The party is going to have either go down, or it's got to lose so badly that the batsh*t crazy are tossed out in order to save it. I don't really think that is going to be possible anymore, not with folks choosing to drop out than service a radicalized agenda.

And that is more the point. What is being touted as "Conservative" today is anything but. It is a radicalized vision that only pays lip service to Republicanism, only really identifiable by the team name, than anything looking like policy for the promotion of the health of the Republic. We need less "Conservatives"--and yes, I use the quote marks because what is being touted as Conservative lately is anything but--and more Republicans. Or Whigs. Or folks who actually have vision that will promote the promise of the nation, as opposed to radicals who hate everything about it, save the flag and a few of their neighbors.

That is problem right there. "Social Conservatives" who aren't terrible social and really dislike their communities and neighbors and who have a radical vision of what society should be, and never was, but damned if they want to get back to it. And if the nation has to burn to get there, then so be it for them.

The cheering section lately has been cheering that burn. And waving flags for it...

Well, they consider him almost a God here in Utah for it... Like there had never been a successful US Olympics before. Oh well, at least it helped get some infrastructure the Valley needed, like a halfway decent transit system.

Really all that happened is that they had everything in place, the bribery scandal broke(IIRC, it was a long-known thing, nothing specific to Utah), and he stepped in to be the new face of the Olympics.

It was a bit strange to see it used while devoid of context or specifics, but I'm guessing he used the phrase to mean that whatever he was responding to was only, in his mind, 100% "i heard it from a friend who heard it from a friend who heard it from a friend who..." and not actually based in fact.

while you are right about the spread there have been news stories that basically say the electorate are asleep and will be until oct. yes there have been some ads run with the steel mill folks and this stuff gets traction among us but i'd bet a weeks pay if i ask at work what happened over the weekend re the campaign -- blank stares.

this is going to be bad for romney from now till nov but it will have to be reintroduced again and again.

That's going to happen. In one month, the Obama campaign has turned his two biggest talking points into liabilities.
He can't refer to anything he did as governor, because they can bring up Romneycare, and he can't stump with his "I have private sector business experience" talking point anymore without someone bringing up Bain Capital.

The majority of his sales pitch to voters has been neutralized, and he can't go on the offensive because his people will have to spend the next several weeks bending themselves into pretzels to try to explain away that he flat out lied to voters.

You have to remember, the Obama campaign team was the one that brought down the Clinton machine after a year of pundits saying Hillary's nomination was a lock. They can handle a lightweight like Mittens.

I believe it was Perry that called it "Vulture Capitalism".

For a candidate trying to pass himself off as a straight talking businessman, who knows how to lead, the Romney Campaign has been looking incredible inept and prone to mealy-mouthed double talk on a number of issues.

Amazing, isn't it? If there was one positive thing to come out of the whole Sarah Palin disaster - and come on, it was a disaster on every possible level - it was that the GOP had learned an expensive lesson about vetting their candidates. Only now it turns out they didn't learn that lesson at all.

Yes, but that was among a group of people who don't view vulture capitalism as negatively as the rest of us do, so of course it didn't get the same traction. They hear the word capitalism and that's all that matters... everything is ok.

Just listened to Joe Scarborough this morning try to spin this whole thing.

It had a sadly hilarious charge of the light brigade vibe to it. His heart wasn't in it, but he played the part of the good soldier.

How do you think people would react if they learned Mitt Romney earned 2.5 mill a year for 2 years for being CEO of a company that he says he did absolutely nothing for those two years? On top of the shareholder earnings, which were even bigger.

That's probably why we will never see those tax records.

They did.

He was less of a disaster than the other people in the race.

Imagine if it had been Santorum, or Gingrich had got the nomination (as the runner up and #3 in the primaries). Romney is clean as a whistle compared to the train wreck of those two.

Basically, every upstanding, level-headed, respectable Republican politician doesn't want anything to do with the Republican Presidential Nomination process. You have to start out by appealing to the most wackjob far-right extremists through a blend of xenophobia, racism, neo-fascism and appeals to fundamentalist religious beliefs. Once you've been vetted as ideologically approved by the far-right that takes the lead in the nomination process, you have to dash back towards the center to win the general election, without being too burdened by the ridiculous things you had to say in the primaries.

The only reason Mitt Romney succeeded in this process is that he'll say anything with a straight face, no matter how absurd, if he thinks it will get him votes. He's a liar on Nixon's scale.

The people who the Republicans would want to really vote for in a Presidential election would never run in the nomination process they have set up.

That will happen as soon as he admits he is rich and always has been rich and not try to pretend he was poor and knows how it feels to be poor. If he did that a) most people wouldn't care nearly as much and b) he can really play the "they are out to get me because I am rich" card. But that is never going to happen, he has invested too much in pretending what everybody knows isn't true.

Yep. And his tax-free retirement compensation taken from vultured company plans could easily exceed that. The reason the old SEC filings say greater than $100,000 is because at Bain, Romney was self employed. Bush's 2001 tax cut (EGTRRA) made retirement plans more beneficial to the wealthy self-employed. Prior to EGTRRA the cut off for benefits (a percentage based on salary) was a salary that exceeded $100,000, after 2001 there was no salary cap.

The tax forms Romney will never want to disclose are the old 5498s. These are the forms showing the roll-over amounts from the plans Bain vultured into his personal IRAs. Here, it's box 2 if you are interested, PDFk

My favorite part of this has been Romney's "No Evidence" ad; Romney's immediate response to Obama's ads claiming he outsourced jobs was to put out an ad saying "Can we afford to trust someone willing to lie to win an election?" This ad will certainly not have a chance to bite Romney on the ass.

It was airing on youtube this weekend and made me laugh every single time I saw it.

So he was running Bain insofar as it let him retain residency to run for Governor, but not running Bain insofar as having anything to do with any of the actual operations of it.

Man, Mitt Romney was running and not running a company at the same time. He really IS the quantum candidate!

Also no, that wasn't talked about in the FactCheck piece, which is why they were able to incorrectly call Obama's allegation false.

It was a really stupid accident. The battery died on my rented motorbike so I had to kick start it, it kept stalling every time I'd put it in gear, I gave it a little more gas to try to keep it from stalling, ended up giving it a bit too much gas and before I could hit the brake I hit a concrete parking garage column, which stopped my forward progress but not before I went face first into said column. Let's just say it's the last time I ride without a full face helmet, and that I'm incredibly glad that I sprang for the shatterproof polycarbonate lenses on my glasses. Other than a few bruises and the gash that had to get glued shut, I'm fine, the rest of my face was protected by the smog mask I was wearing.

/I ended up comparing motorbike crash bruises with the bartender at my hotel.
