Quite often if precautions aren't taken, which is why a lab has to have very strict requirements and personnel have to be very careful. I hope that lab tech gets fired.

That's an excellent question. Forensic labs are usually way to busy to be running random DNA samples. One option is that the chain was a part of a crime in which the investigator had good reason to believe it belonged to a suspect. A second option is that the cops lied to the forensic personnel. A third option is that the particular lab hasn't set in place a requirement to the cops that they can't just give the lab every little thing and tell them to run it, which means the lab isn't low on money or personnel. If that's the case, and they are low on money or personnel, then they are wasting time and resources running every little sample; time and resources which could be used to solve actual cases. A fourth option is that it was a mistake that the chain made into evidence. And lastly, it could have been sent to a private lab, which may have lower standards (which may be why the error occurred), at higher cost to the police (assuming that the normal lab rejected the chain, and the cops wanted to pursue this line of investigation).

Absolutely. We keep several databases of DNA. Usually one is kept at the state level, and one is kept on the federal level. As of right now, we're only allowed to keep DNA from unsolved crimes and from people charged with a federal crime (note that I said charged, not convicted). Usually when a sample comes in that has no reference sample (such as the saliva from a known suspect or from a victim), we run it against the databases to see if there are any hits.

With these databases, we've been able to solve quite a few previously unsolved crimes, and we've also been able to link crimes together even if we don't know who the suspect is.

A new up and coming technique is called familial searches, in which we use the DNA of a suspect who isn't in our database, and connect it to parents, siblings, or children of the suspect that are in the database. It's how we (actually, they, as I wasn't involved) caught the the Grim Sleeper in LA. His son was arrested for a felony and had his DNA on file. Someone was running a search to see if the Grim Sleeper could get any hits on the DNA database, and they found a 50% match to his son. But don't get me wrong, this wasn't a random search (oh, look! we've got a 50% match, maybe that's him!); they had to go through a bunch of legal proceedings to even be allowed to do a familial search, and appropriate technology had to be developed. It was planned out to do a search specifically looking for relatives.

I'm under the belief that those that maliciously and intentionally cause the death of another human being should never taste the air of freedom again. If there is a visual record of them doing so, then the death penalty gets put on the table. If it's just DNA evidence? Life without parole. If it's to the point where no one can dispute that that person did it? Death. That would narrow down the death penalty to so few cases, that no innocent will be put to death. It would have to be a very high burden, but not an insurmountable one. But 99.99% of murder cases would end with life sentences.

There's a list of classic signs that most serial killers exhibit. We have been able to use that list (and other psychological factors) to help convict other serial killers when they otherwise would have not been convicted. The only reason we know anything about the psychology of serial killers is because we've been able to interview them while they were in prison. If we execute killers, we'll never be able to interview them, and we never would have gotten that knowledge. If we start executing all killers today, who knows what we'll never learn because of it.

It wasn't that it was a protest, the chain was used to open gates up that allowed people to ride the subway for free. i'm sure that they ran DNA in the hopes of catching that person and charging them criminally as well as financially for the days losses.

Since there was apparently no camera shot of the person that did this, the only evidence would be DNA on the chain.
