What?? No. I'm a non-smoker and I like the top floor; don't have to listen to the stampede of kids and fatties. If anything, entire apartment buildings (in a multi-building complex) need to be non-smoking. I don't want to smell it wafting up from your apartment, and I don't want your butts all over the breezeway.

If you can't control your addiction, then you need help.

I like cookies and sweets, but I don't need a 15 minute cookie break every 2 hours, I don't get crabby when I don't have a cookie, I don't have a cookie when I'm stressed or nervous, and I don't bum cookies off friends.

And I have yet to find one person that smokes an occaisonal cigerette. They are either all-in, or abstinent.

I have one every couple of months. I have a smoker friend and I smoke when I see them.

I Was all-in for about 2 years. I'm lucky that I'm relatively drug resistant. Nicotine doesn't get to me very badly. Sure is nice though, I can see why people get trapped by it.

That was my point is I am able to control my addiction; the top floor thing was only an idea.. Since smoke rises. We smoke on our porch; thus outside and it helps to smoke less. I personally have also added an e-cigarette to my repertoire so as to smoke less and smell less.

/It was just an idea; better than telling people what they should or shouldn't be allowed to do with their own bodies.

Jirafa: As someone who is really sensitive to cigarette smoke, I see no problem in banning smoking in buildings with multiple residences. The smoke can come right into the other apartments, through the ventilation systems and through small gaps in the walls, floors, and ceilings. You can move, but there's no telling if your new neighbors smoke, too. And no telling if the people who move in next door a month after you do decide to smoke in their apartment. Plus, getting a house is just not an option in many parts of the country. Smoke can be a serious problem for some people, like those with medical conditions, people who want to keep their kids away from smoke, or even people who simply want to just not have all of their stuff take on a permanent cigarette odor.

That said, the ideal solution would be to ban smoking on a building by building basis, instead of banning it outright. If all the units in an apartment building are designated smoking units, then there should be no problem in allowing it to continue that way. You know what to expect when you sign your lease to live in a designated smoking building, and if you want to you can smoke inside without bothering your neighbors. That would satisfy the market demand for smoking apartments AND allow non-smokers to choose whether to be around smoke or not.

As for the public park smoking ban ... that makes less sense than the apartment smoking ban. Just don't hang out too close to or downwind of the smokers, and you should be fine.


You are responsible for being aware of your health concerns and taking the necessary measures. You and only you. You're sensitive to smoke? Don't rent in a building that permits it. I am allergic to shellfish. I don't think that there should be a law banning shellfish except in seafood restaurants. I am aware of my health issues and make damn sure that whatever establishment I am dining in is aware of my dietary concerns. Muslims and Jews have to do the same with their dietary concerns. I have yet to see anyone seriously proposing a ban on pork...

Thanks for answering my question. And proving a point that you never ask a liberal about taking away personal freedoms they don't agree with. I'd tell ya to go have a smoke and relax but you have no where to go do that.

Freezingprocess: Electronic cigarettes have come a long way in the past few years. They hit hard like a real cigarette and are legal to smoke in most movie theaters and restaurants.

Also, occasionally someone will tell you that "you can't smoke in here". Then you get to say "I'm not" and then proceed to blow water vapor at them.

Ok, That last part has never happened to me, but it is fun to ponder.


One of my favorite things to do with my old electronic cig: At a stop light while driving, this old lady in the passenger side of the car to my left look over while I happened to be dragging on the fake cig. I looked at her, plucked it out of my mouth and proceeded to "put the cigarette out" on my palm while making a "hurts so good" face.

She whipped her head to be facing forward and just pretended I didn't exist. I loved how wide her eyes got hehe.

Since then I've gotten a battery with a blue light on the tip. It's more convenient than explaining that no I'm not smoking indoors yet again. Folks see the blue, they know it's some gadget and not a cigarette.

I'd wager that these laws are in place to take care of the most greivous offenders, you know, the people who are just asking for it. Like jay walkers. It will be selectively enforced, and used as a tool in an officer's bag of tricks to screw with people who deserve being screwed with.

A large motivator for the banning of smoking on the beach or in parks is due to the number of people who treat these areas as a giant ashtray - if they can't be bothered to put the butts in a proper receptacle, they should expect to annoy others to the point where a ban is considered.

Even if you ignore the littering aspect, the smoke doesn't magically disappear just because you're outdoors. Anyone in close proximity to the smoking might have to smell it, and quite frankly burned tobacco is not a pleasant odor. Of course, the same applies to flatulence, and I've never heard of a legally binding ban on that...

/dried, unburnt tobacco smells awesome though

From one smoker to others:

Do put your butts in some sort of trash receptacle. If they don't have a butt can, flick the end of your cig until the remaining (if any) tobacco falls out. If there's any cherry left, step on it. Throw the not-on-fire butt into a regular trash can.

I swear. I do that here in Virginia and some people look at me like I pulled a quarter out of their ear, as if somehow it was not possible before to not throw a butt on the ground wherever you happened to be.

And yeah. Smoking inside is just disgusting. I hate life in Feb with the wind blowing a good 30MPH in 20 degree weather, but shiat, it doesn't take THAT long to smoke one.

Coin collections and guitars hate smoke!

Apartment managers already have a huge incentive to go non smoking. Smokers destroy the apartments they're in. Cleanup takes a lot of work. If there was no market, smoking rooms wouldn't exist.

Not all smokers smoke in their houses... Case in point; because it is nasty to the rugs, walls, any other fabrics, not to mention the havoc cigarette smoke causes to electronics; I am a smoker of 26 yrs and do not smoke or allow smoking of cigarettes in my home. However, in the winter, we smoke with an exhaust fan in the bathroom; where the walls are easily cleanable and the room can get wiped down regularly. These are some ways that smokers who know the yuckyness factor and the serious issues cigarette smoke can cause to apartments and particularly computers.
I have yet to have a landlord complain as I keep things clean.

Smoking in the bathroom using the exhaust fan is a horrible idea. In older apartments the bathroom exhaust fan ducting may be connected to multiple units.

Had a neighbor in my college apartment try to smoke in his bathroom. The smoke leeched into my bathroom via the exhaust duct. It was nasty.

I asked a stanger for a cookie once, and he had a fresh and chewy double-chocolate chip toffee cookie. It was wonderful. But then I got sleepy. Later my butt hurt. But damn that was a good cookie.

To be fair, freedom is freedom and principles can apply to a wide set of values that seems unrelated. For example, freedom of speech is freedom of speech and it doesn't stop being freedom of speech when it goes from somebody reading a laundry list of complaints to their congressman to one of those idiots from Westboro standing on the street waving around his stupid sign.

The fact that smokers are dumbasses who intentionally minimize important rights because they're more concerned about trivial applications of their rights is a whole separate thing. It's not that there's a difference in the principle of freedom between the big gulp and gay marriage, it's just that only dumb people spend a lot of time worrying about the drink. The people are the problem for their application of the principle, not the principle.

Then you shouldn't have rented in a building that allows smoking.

I must reiterate the fact that smokers are horrible people who only care about themselves, but the fact is that the property was owned by a single entity and that entity had the right to set the rules and you almost certainly knew of those rules before you signed your lease.

What they should do is ban smoke from wafting across properties. Fine people who violate the ordinance just like they would a noise complaint. You want to smoke on your property? Cool.

Just make sure it stays on your property.

Why should it be incumbent on the person bothered by the behavior to move away? It seems that a better solution would be designated smoking and non smoking areas. Give people who want a place to smoke a place to do it and just tell non smokers to stay the hell away.
