That's an interesting point. However, since you allowed them to come in your business, and purchase fireworks if they were inclined to do so, you weren't discriminating. You weren't in the business of handing out flyers, you were in the business of selling fireworks. Your business license said nothing about flyer distribution, only about firework sales. Now, had you been in the business of flyer distribution, you might be on a bit of shaky ground. For instance, should a package delivery service be able to refuse to deliver flyers for a Klan rally? I don't know. But no one is talking about hate speech delivery here, so this is not relevant to the topic. The lesbians were being hated, not spreading the hate themselves.

As far as the park goes, if the lesbians had tried to shoot fireworks there, which might be completely legal in the city, the employee could have asked them to stop, since that was interfering with the purpose of the park, which was to provide an area of outdoor beauty for quiet enjoyment by the public.

Hate to tell you this, but the Supreme Court decided you were wrong about 48 years ago.

Actually, no, it didn't. Title II of the Civil Rights act of 1964 does not apply to private clubs, or organizations not engaged in interstate commerce.

The question was about a private park that is open to the public, same as if it were a lunch counter in Greensboro. So yes, the Civil Rights Act and accompanying court decisions are applicable here. This was not a "private club" that decided the lesbians couldn't become members.

Furthermore, the Kentucky Civil Rights Act of 1966 prohibited discrimination in accommodation in facilities open to the public.


Oh it's most likely against the law, both Federal and State. IANAL, but it doesn't seem like there's much question. I'm just stating that if it's private property, and the owner wants to be an idiot, let him. He won't be in business for long, and we'll know much quicker that a racist/homophobe/anti-religious/whatever moron is running about. All these types of laws do is force the idiots to be more covert about it and, basically, protect them from themselves. My wife works in the Mississippi Delta, and there are literally two of everything. Two Piggly Wiggly's, two Wendy's, two (or more) laundromats, two sets of apartments, etc. etc. And one is the "white" version while the other is the "black" version. It's not because the whites refused service to black people, but rather because black people didn't feel like they were being treated the same as the white folks (and they very likely weren't) so they just decided to open their own stores.

Wouldn't it have been better to let Racy McRacist to keep openly discriminating and going out of business as a result? I know the perception of the South is that we're all a bunch of racist hillbilly sister bangers, but the attitude has changed for the better over the years. When these fliers I mentioned were being distributed last week and tacked on the doors of businesses during the middle of the night, the police were more concerned for the safety of those holding this "conference" because people were so outraged by it. And this area is overwhelmingly white.

Now, as much as I disagree with them being told to leave for being gay, I will point out PRIVATELY OWNED, = PRIVATELY REGULATED.


But I won't assume the article is factual 100% factual just because pissed off people usually never tell things like it actually happened. I will also point out that the same people that are outraged over a private property owner having property rights are also the same people who believe business owners have the right to legally invalidate conceal carry permits & ban weapons on their premises, even if "in public".

You missed my point and it's a sore point (and a thread jack, sorry) - how, exactly, does having a yellow magnetic (or sticky) ribbon on your vehicle support troops? I mean what good does it do other than making the owner fell better? I visit the local VA in Duluth, GA, every month and interact with vets that "live" there (think nursing home). My gal and I head 450 miles every month (well, almost every month) to Camp LeJuene to take a load off a severely PTSD Marine's head for a few days. That's the kind of things I think when I say "I support our troops." A f*cking magnet on the car ain't shiat.

Thank you. I'm a gay man and while I've never been assaulted or fired, it's been rough at times and caused enormous amount of depression.

When people ask why gays go to pride events or have camaraderie, it doesn't anger me, but it does get me frustrated.

Back around 1988 or so I had never heard of the rainbow flag and was yakking with a guy that owned an auto body shop. I asked if he could paint a guitar for me (electric guitar body) and he was all "Sure, no problem" and I described my idea for a guitar. I envisioned a ROY G BIV metallic, shiny, color scheme and he....kinda looked and me and walked off. Ran into him prolly 10 years later - after I found out about the rainbow flag and the meaning - and we had a good laugh. He thought I was hitting on him!

/I still think a metallic rainbow paint scheme would look cool on a guitar....

Its simple: persecuted minorities, from Christians to gays, have always rallied around symbols to identify and covertly empower their fellow members. Christians wore Ichthys pedants. American blacks appropriated the word "n*gger" as casual (oft friendly) moniker for fellow members of their community. Gays chose rainbowed flags (as one of) their symbols. Its not because they want to be special. In fact, they are acting just like every other persecuted group in history.

The symbols of the majority are codified into our very society. You cannot go five minutes in America without seeing a scantly clad whore shilling motor oil with her bronzed curves. Heterosexual sex is deeply ingrained in American culture. Why do you need a "Straight" Pride Parade" when any event is full of heterosexual couples displaying their "pride" in public without fear of persecution?

Finally, I would recommend conducting introspection into why you feel jealousy toward the Gay Movement. For the most part, gays are not looking for special treatment. They merely want to have the same rights as heterosexual Americans. The right to marry and then divorce the person you (used to) love. The right to be a parent. The right to express your sexuality, within the same social norms are straight couples, in public. And above all:

The right to be judged on the merits of your heart and mind and not with whom you choose to sleep.

I'm a gay woman who's been through all of that (and will continue to - I still haven't had the guts to come out to my parents, who are very vocal in their anti-gay beliefs - oh God, that's going to suck), so yeah, I absolutely understand where you're coming from. Frankly, I've pretty much given up on us ever really being accepted, at least during my lifetime, but these homophobic idiots' behaviour still makes me want to kick them in the nuts with a stereotypically steel-toed boot.

Well, since commerce does occur there, even if they weren't actively participating in the commerce (say for instance they were on the nature trail, which doesn't have a fee). Wouldn't this be the same as someone who entered a business while accompanying someone else making a transaction, or in contemplation of purchase of merchandise?

I don't think it can, and only because while both of them *could* have rented the space, for their visit they had no intention of engaging in commerce. They were playing the role of the public in a public space, and would probably be judged along those grounds. I'm saying I agree, but I can see it being argued that way.

If I, a straight guy, put a tag on my car saying STRAIGHT someone would get all pissy about it and give me shiat about not being sensitive to diversity. But if I'm gay it's 100% Kool Mo Dee fine to have a rainbow flag, essentially announcing that I'm gay.

Why is there that double standard?

OK, I'm stirring the pot a little but sometimes the pot needs to be stirred. Double standards piss me off.

Its simple: persecuted minorities, from Christians to gays, have always rallied around symbols to identify and covertly empower their fellow members. Christians wore Ichthys pedants. American blacks appropriated the word "n*gger" as casual (oft friendly) moniker for fellow members of their community. Gays chose rainbowed flags (as one of) their symbols. Its not because they want to be special. In fact, they are acting just like every other persecuted group in history.

The symbols of the majority are codified into our very society. You cannot go five minutes in America without seeing a scantly clad whore shilling motor oil with her bronzed curves. Heterosexual sex is deeply ingrained in American culture. Why do you need a "Straight" Pride Parade" when any event is full of heterosexual couples displaying their "pride" in public without fear of persecution?

Finally, I would recommend conducting introspection into why you feel jealousy toward the Gay Movement. For the most part, gays are not looking for special treatment. They merely want to have the same rights as heterosexual Americans. The right to marry and then divorce the person you (used to) love. The right to be a parent. The right to express your sexuality, within the same social norms are straight couples, in public. And above all:

The right to be judged on the merits of your heart and mind and not with whom you choose to sleep.

I'm interested in why you think I feel jealousy toward the Gay Movement (caps? Ok, whatever). I never questioned the right to marry and divorce, the right to be a parent, I just questioned why anyone would express "I'M GAY" via a rainbow flagged license tag. Sort of like why would I express "I'M STRAIGHT" or "I BLOW GOATS"

Fluorescent Testicle: Wayne 985: Thank you. I'm a gay man and while I've never been assaulted or fired, it's been rough at times and caused enormous amount of depression. When people ask why gays go to pride events or have camaraderie, it doesn't anger me, but it does get me frustrated.

I'm a gay woman who's been through all of that (and will continue to - I still haven't had the guts to come out to my parents, who are very vocal in their anti-gay beliefs - oh God, that's going to suck), so yeah, I absolutely understand where you're coming from. Frankly, I've pretty much given up on us ever really being accepted, at least during my lifetime, but these homophobic idiots' behaviour still makes me want to kick them in the nuts with a stereotypically steel-toed boot.

I came out recently to my mother, who turned out to be supportive, but one thing I found is that the affirmation of simply admitting it was positive in itself. In other words, there are two scenarios to coming out:
A. Your parents lash out, but you can take pride in your courage and know that they are the ones with a problem, not you.
B. The knowledge that their daughter is gay causes them to re-examine their beliefs, either then or later on and the rest still applies.

I don't know if that helps, but for me it was like parachuting out of a plane. The fear before is actually the worst part. I obviously don't know you well enough to be giving detailed advice, and I don't know what will happen, but it's probably a safe bet that either scenario is preferable to hiding in fear forever.

It is funny how civil rights act protects only some minorities. It would be interesting if a gay/lesbian black couple went into the park. It would be illegal to kick them out because they were black, but legal to kick them out because they were homos.
