If I remember correctly, I didn't really pay too close attention to this since I don't live in New York, Big Gulps aren't even banned. Since they are sold a convenient stores which are classified as grocery stores, the ban does not apply.

That is right. Also stores can still sell "fountain soda" and let customers fill up their own souvenir cups that they just happen to sell.
