No shiat. Posner was always the right-wing poster child of what they thought a "conservative" judge is supposed to be. He has always basically been Ayn Rand in a black robe (though slightly less masculine-looking). If even Posner says the Republicans have gone crazy, then you know they've really gone over the cliff.

After Scalia's fiery dissent in the Arizona immigration case, in which he took aim at President Obama, Posner wrote in Slate that Scalia was becoming a political actor: "It wouldn't surprise me if Justice Scalia's opinion were quoted in campaign ads."

Scalia is the biggest political hack that's ever donned a Supreme Court robe. He's never met a decision he can't rationalize.


Scalia is a strict constructionist. He will construct whatever argument supports the current conservative agenda.

Scalia has remained consistent in his judicial philosophy. Posner has just admitted that he's gone liberal in his judicial philosophy in reaction to a political party. Judges aren't supposed to do that.


Nonsense. In Bush v. Gore, Scalia departed from his long held view that the Equal Protection Clause doesn't exist.

The only way it will change is by voting for Gary Johnson (or Obama) instead of Romney. If they know you are going to vote for them anyways no matter how crazy they are it will never change.

It's going to happen sooner or later, there will be a big split, the question is when.


I've already got a plan to sabotage Romney locally. My area is pure Southern Baptist. Not once in the past 50 years has it gone Democratic or otherwise on any level. I plan to deliver to every mailbox in the area a letter supporting Romney where he talks about his Mormonism and how he feels it's the only true Christianity. The day after I do that I plan to deliver another one with a cd that shows him on video talking about his support of gay rights and him increasing taxes in Taxachusetts. This will all happen within days of the election.

This. If I didn't know better, I'd think that the conservatives had deliberately been running the Long Con for the past 30 years:

1. Recruit and embrace emotionally-motivated and vocal demographics -- evangelicals, hardcore libertarians, John Birchers, etc.
2. Use those demographics to pull your party radically -- even nonsensically -- to the right.
3. Denounce those from your party who didn't follow the sharp rightward movement.
4. Expect the liberals to tack rightward ("to the center") to appeal to the moderates and those affected by step 3.
5. Voila! Your adversary is suddenly standing where you were back at prior to step 1.

That's how the GOP's St. Reagan wound up left of the current Democratic administration on many issues.

I used to read his opinions and essays back in college and law school for the outrage factor. I rarely if ever agreed with him, but at least he wasn't certifiably looney tunes. I could chalk up my difference of opinion with Posner to having a different value system than him.

You know, as opposed to existing in a different reality. The reality I live in -- the one where the president is a center-right friend to the corporate and banking lobbies, was born in the United States, and has no plans to execute millions of senior citizens through sinister death panels -- is the same reality shared by Posner, and a wholly different reality than that of his former conservative allies.

Anyway, welcome, Dick! Take a seat. As an added bonus I think you'll find the beer is better on our side.

Pretty much mirrors my thoughts.

I lean toward some of the more basic conservative tenants, especially fiscal, but man, many of today's 'conservatives' are knuckle dragging idiots. And there so farking loud and prissy.
