And it sounds like the pre-nup thing and the disappearance are correlated, but not because she's at fault: he suffered from manic episodes, and would choose to stop his medication on purpose when he was stable, which is hella stupid. Article says that one time, he physically abused her while she was pregnant, and threatened to kill her father.

this is so common. this is one of the reasons that teenagers were committing suicide after they stopped taking paxil. (toss in side-effects with sleeping meds and you have a death party)

During my trip to Ilium and to points beyond-a two-week expedition bridging Christmas-I let a poor poet named Sherman Krebbs have my New York City apartment free. My second wife had left me on the grounds that I was too pessimistic for an optimist to live with.

I might have been vaguely inclined to dismiss the stone angel as meaningless, and to go from there to the meaninglessness of all. But after I saw what Krebbs had done, in particular what he had done to my sweet cat, nihilism was not for me.

Somebody or something did not wish me to be a nihilist. It was Krebb's mission, whether he knew it or nor, to disenchant me with that philosophy. Well done, Mr. Krebbs, well done.

Control and ownership aren't the same thing, and someone has to pay the bills while he's missing. One hundred million in assets can't just sit there and gather dust until he turns up dead or alive. Someone has to write checks for mortgages, lease payments, maintenance, brokerage fees, etc.

I didn't read the whole article so lmk if the answers to my questions are included:

Why does the prenup apply? She's not seeking dissolution of their marriage while he is missing is she? How long before he's declared dead? Wouldn't she just keep managing the family assets in his stead? Does he have some sort of power of attorney preventing her from doing this? It sounds like ABC has farked this up (I know Surprise!)

Not a lawyer but I have had to deal with the probate process a few times. That said, unless a parent is specifically noted as an inheritor in a will, they have no claim against the estate of a deceased offspring if there is a surviving spouse of child. So unless the following is true, I do not see how a judge would touch it:

1) There is a will, stating the mother inherits the estate
2) The prenuptial states the wife gets nothing in the event of death, and/or will never have control of the estate
or
3) Due to mental issues with the husband, the mother was given power of attorney to act as trustee for the estate.

Any IRL lawyers out there know differently?

Not a lawyer but I have had to deal with the probate process a few times. could be a lot of things. Or it could be that the mother is technically fighting for the assets, but doesn't have a legitimate claim, and will probably have her suit dismissed. I don't really feel like reading the article, or trying to find the actual filings in the case to give you a more thorough analysis, since you haven't paid my retainer yet...

I would, however, note that the media - all media - tends to report on the more SENSATIONALIST aspects of legal proceedings without ever following up with the more mundane results...

Apparently it is. As to the point? Well even if it can be overturned a pre-nup makes it HARDER for a gold-digger to steal all your money and leave you alone.

Really though, the fact that he was a repeat-offender in terms of going off his meds and the fact that his mother is clearly also insane (it takes a special type to be meddling in her son's affairs when he's got kids and 100 million dollars) and the wife was clearly a trophy, this kind of thing was just inevitable.

Best bet would be foster home and trust fund for the grandkids and leave the crazy biatches nothing.
