They ruled that what 0bama created is a tax. 0bama, the constitutional scholar, created it, not the SCOTUS.

If 0bama created something else and called it a magic unicorn fee and the SCOTUS determines it is a tax, then it is 0bama who is responsible for taxing people, NOT SCOTUS.
