Yeah, I know. First thing I tell people, no posting of my image or GTFO. Seriously. Even told my mother-in-law to never post pics of my kids. I'm going to keep the onion on my belt though.

In this instance, I think they'd have a good case that they're acting as "models" for the group so even if the copyright holder authorized it, they could still sue, unless they signed a blanket model release. It's like if you take a picture of me walking down the street, you hold the copyright to the image, but, if you use that image for the cover of the DVD box of your new documentary "People who Pretend to Understand the Law on the Internet," I could sue you for using my image to promote your movie.

Eh. In my experience there are two types of homophobes: the bible thumping ones who are full of bile and fury about their own shiatty lives and go out of their way to find a target, and the ones who are full of hysterical visions about the horribly seductive, terrible homogays' activities bringing down society with their sexy, sexy sinfulness.
The former tends to be straight, but horribly ignorant and boring to listen to, and the latter tends to have a whole closet of lubed up pony-sized dildoes ready to go at the drop of their sweat-stained tighy-whities.

He's asserting fair use as either parody or political speech, but I can't recall any case involving the use of a private person's image, (as opposed to a public figure) without their consent, for either type of speech. It's an affirmative defense, so he's basically admitting that he's infringing on the photographer's copyright already.

They're non-profit. Fark Photoshoppers don't charge for their work. I think this is a perfect opportunity for a Fark Photoshop to help out this organization. It'll be are little bit of charitable work. Certainly we could develop some posters for them to use.

Yeah, that's why I said I'm not sure. A little googling basically says that public figures are mostly fair game for noncommercial speech.

Parody
An episode of the TV cartoon "Family Guy" made fun of comedian Carol Burnett's image and signature characters from her 1960's comedy variety show. In Carol Burnett v. Twentieth Century Fox, the court ruled that the show's use was fair, in part because the "Family Guy" episode was designed to parody Burnett as a public figure, using a relatively small percentage of copyrighted material, and would not substitute for the original in any market.


That being said, I think the only claim here is probably going to be a copyright claim, which the photographer, in the comments in the article, says she owns. No other cause of action springs to mind that the couple themselves could bring...
