This story is confusing. So the victim pulls a gun, leaves, returns, and is shot by the other guy? When did the other guy get a gun?

I am sure I will be called some names here by saying this but...I am going to wager that he did not "buy" his weapon and ammo in the traditional sense that you and I would procure such items. Like I said, just a guess...

I'm actually most curious about the part where the crowd convinces the guy with the gun to leave, and it seems nobody thought they might want to call the cops so long as he did leave. The libertarian in me can really appreciate that, but I tend to doubt this crowd had those same leanings and thought "we don't pay anything in taxes, so let's not burden the system by calling the police needlessly".

Late to the thread, but when Massachusetts cigarette prices started to rise because of state tax ($4.00 a pack) I noticed everytime I lit up someone would always try to bum a cigarette from me. Every time. It got so bad I started saying no.


That's when those people who asked and got a no answer started copping an attitude, like they were entitled to a cig. A couple of time I got threatened because I said no. Because of a cig. One guy refused to walk away from me unless I gave him one. That's when I decided it might be time to quit, because if anything smokers can be cheap bastards. Now cigs are close to $7 a pack so I supposed I would have been murdered by now for just saying "No" to someone.

2. Ferguson refuses. Thervil pulls out gun.
3. Everyone else there tells Thervil he should leave.
4. Thervil comes back, I assume with the gun from before. Gets in fight with Ferguson. Ferguson shoots Thervil.
5. Ferguson is later arrested and charged with first degree murder.

I'm not a CSI or anything, but it seems pretty cut-and-dry that this is anything BUT first degree murder. If Thervil came back there and Ferguson was killed, I could see charging Thervil with first degree. But it's totally possible that Ferguson shot Thervil with Thervil's gun by accident when they started to fight. And even if he shot him on purpose, Thervil is armed, which makes Ferguson shooting Thervil self defense. I just don't see how Ferguson could have planned that Thervil would come back, and isn't that the whole point of first degree murder, that it's planned ahead of time?

Oh wait, he's black, and I must have missed that Florida tag.

Now it all makes sense.
