I knew that the gov't had argued that it was a tax in the lower courts because of the way that the issues panned out in some of those cases. I also knew that because of that the gov't had placed the tax bit in its argument as an outlet in case what it actually wanted failed. And that's what happened. I didn't mean to imply that Roberts was unaware of any of that prior to writing his opinion. Sorry if you didn't like the way I phrased it. I was trying to reference the bit about the commerce clause, the main gov't argument as mentioned above by others, failing in court, so another route had to be taken.

Keep in mind that team Obama is still saying it's not a tax, just as it had previously(even as its lawyers were arguing in court that it was - because whatever it takes to win, right?), and will now spend a lot of time and money explaining how it's not a tax. Maybe George Demokraticus can interview Obama again and we can get the issue ironed out once and for all.

No, that thread was pages of Fark Independentstm making sure that they believed all of us "libs" were butthurt. It pretty much defined the modern American political dialogue in 2012. If anybody tried to defend themselves, they received the same tired .jpeg or the word "butthurt" over and over. I haven't seen much comparable gloating from the "libs" in the numerous ACA threads except to point out what a bunch of whiny biatches they are.

Basically the conservatives and Fark Independents tm are really showing their colors here: whiny biatches who didn't get their chance to gloat. Grow up.
