I don't think people should go to prison for lying about medals or service, but I think that veterans should be allowed to kick their asses without being prosecuted for it.

Sorry, but in this country you have the right to lie about nearly anything you want. In order for it to constitute fraud you actually have to attempt to derive some specific material gain. Your belief that the only reason to lie about having an award is to realize some material gain is not only wrong, it's irrelevant. That's like saying we should outlaw all guns, because when people have a gun they're always looking to kill someone.

Think about it. If you let a law like the Stolen Valor Act stand, then you won't be able to strike down laws that would make Fox News tell the truth.

Besides, people who want to 'steal valor' don't do it for partisan reasons. They do it because they are attention seeking asshole liars. I don't know many people on either side of the partisan divide that would do something like that.

I seriously doubt that even most people faking having an award are looking for material gain. More likely they are sad little men looking for attention. Anyway, laws against fraud cover the ones you are speaking of so there is no need for a new law.

So, he did lie to a governmental board, although it sounds like in a sort of "unofficial manner" (although, if during a meeting, I guess that could be considered "official"). And, I would think the lies in those types of situations would already have laws/penalties for that, and you wouldn't need to be additionally covered by a "Stolen Valor" act. One might almost compare the "Stolen Valor" law to "Hate Crimes" legislation.


Well, in general it's not illegal to make that sort of lie, even on a resume. You can claim fake degrees and prior jobs all you want, even on paper. All they can do is fire you for unethical behavior if they find out, but you can't go to jail for it unless you somehow claimed it under a legal oath (perjury) or tried to create an official govt record out of a lie (like getting a SSN based on fake documents). I'm sure with some employers it could be illegal, but generally when it MATTERS, the employer does a dutiful background check anyways.

I don't understand the need to pretend you're in the military. Is it for the glory? For the chicks? To make you feel better about yourself because you don't feel you managed to accomplish anything in your life? And if you want to play Soldier, Marine or Navy Seal...please go right ahead and exercise your right to free speech. But remember that when the real thing finds out you're claiming something you're not, don't be surprised when you're being beaten like a redheaded stepchild.

/I do believe that cities should add a rule that if you are elected into office and you have lied about your military service or honors, you will be removed from office.

If you just say it verbaly to impress me, no crime but as have been said....if you use it to gain directly or indirectly, a monetary value of some sort, (benefits, job, prizes, other privileges that could benefit you in a monetary way) then it's Fraud and you can be arrested.
Personally i think this is shiat but hey, if veterans can beat your ass for lying about being a Secret Squirrel Super Seal Ninja, then I'm fine with it.

I think that this will be resubmitted in some form or another that like hate crimes, will give the "Fraud using military status or awards", some teeth (I hope)

Yes, yes you can!

Of course, the employers have the right to not hire you after finding you you lied.

Being a lying bastard is totally a right. Having the right to lie doesn't mean there aren't consequences - just not legal ones (depending on what you lie about and when, I suppose..).


Of course there are legal consequences for lying in various situations - various government forms you fill in (like tax returns), when appearing in court, if you publish your lies and someone can successfully claim to have been damaged by the lie, probably when talking to a police officer (obstructing an investigation), etc.

I wouldn't be surprised if you can sue someone for lying to you (as an employer, private individual, etc.) if you sustain significant material losses and can provide evidence of how they misled you deliberately, etc.

Which is why our normal fraud laws cover this. If I'm conning the shiat out of you, that's illegal already no matter if I claim to be a Soldier or a Spiritual Guru. Plus as others have stated you can lie on a resume and not go to jail. I'm finding it hard to think of a way I could really defraud someone just by claiming I was in the military.

As has been submitted before, I think that if you get caught bullshiatting your military service, then you get snatched up, put in uniform and dropped in a combat zone.

They would have a squadron, platoon or whatever of the Ferocious Fighting Falsifiers and then they can really try to walk the walk. Many of these guys are so full of themselves that they may actually be able to bullshiat some third world dirtbags in to not fighting or actually surrendering but I bet they can't talk shiat to an AK-47 round so at least they'll free up our real soldiers as targets and beach carpet.
