Well folks, the middle class just got the largest "tax" increase in history, and Obama should earn PolitiFacts PANTS ON FIRE rating.

Either way this was going to get ruled, it was going to galvanize the ruling's opposition. The SCOTUS may very well have just handed Romney a victory in November.

Yes, it is. Driving, drinking, they are all voluntary. You can choose to not do it. Can't choose not to exist. Plenty of crunchies only ride bikes and get away with not contributing to the state transportation funds or the federal gasoline tax.

Now, if you start charging non-car owners a tax, bike riders a tax, etc, think that would fly?

I had a feeling it be 6-3 with Roberts writing the brief. Was surprised Kennedy voted against it, to tell you the truth.

The constitutionality was really never in question, the question always was how far would the "conservative" bench radically bend their arguments to why it was not constitutional. Roberts looked at 250 years of precedent and told the base to go pound sand, that he wouldn't go down as the asshat that put politics above integrity.

I can respect that, just as I can respect conservative consistency. Assholes like Scalia need to be throw out, as they're radical and dangerous and not afraid to vote on the winds to reach and ends of whatever idiot sent them a newsletter that day.

That wasnt his argument at all. What if a poor person actually owes money April 15th? That petty $95 you said is painlessly pulled out of his refund becomes back taxes owed. With penalties and interest. No one said anything about cheating on taxes.

This is why some of these Justices need to be dismissed from the bench. Your logic is false, woman. You admit it in the second statement when you use the word "virtually". Not every individual is an actor in the medical care market because: I can go to another country and get health care; I can render my own health care; I can never use health care. And before you invoke Wickard v Filburn and argue all three of those options "affect" the medical care market, we both Wickard was the wrong decision. Robert's opinion is correct, in that it is not valid under the Commerce clause.

The Federal government has to offer the existing program, without changes, in perpetuity? Because states' rights? Congress doesn't have the right to change Federal programs? Will have to read the decision.

The government can't mandate that! When you turn 65 you are enrolled in Medicare. Social Security, selective service, etc. all under penalty of imprisonment or fine for failure to comply. All that shiat is hunky-dory. But making people buy insurance, that's just unchristian!

i love how weak the "it's a tax! obama said no taxes!" talking point is. obama can still say that he disagrees with the wording of the decision - that, like four of the justices, he believes that the mandate is constitutional under the commerce clause. but it's all moot. obamacare stands. this is a HUGE victory for the president.

That is the whole issue. Say you're 25 and you say, "I'm young and healthy, I don't need insurance." So you don't buy any. Then, you get cancer and you try to get insurance, nobody will insure you because you have cancer.

One of my problems with Romneycare is that the young healthy 25 year olds can't just buy a bare-bones catastrophic coverage plan with a high deductible, which WOULD cover them for the long-shot cancer/car crash scenarios...they have to get comprehensive coverage. I guess the idea is to make the pool of insureds big enough.

Not sure if those type of policies would "count" under Obamacare.

They do not. High deductible plans like that are illegal under the ACA. They will need to be replaced. This will further burden companies that employ kids fresh out of college and the kids themselves. Sure, they can stay on their parent's plan till 26 (and then parents pay more) but then they are screwed. They need a very high cost, low deductible plan or they get taxed.


You should read Section 1301(g) of the bill before you talk about this stuff buddy. You can still get a plan with a $6,000 deductible.
