Angry Drunk Bureaucrat: greentea1985: Angry Drunk Bureaucrat: John Roberts siding with the left wing of the court... MY GOD! THE MAYANS WERE RIGHT!

Roberts is a conservative but he tends to stick within the letter of the law of the Constitution, unlike Scalia and Thomas who like to legislate from the bench. Despite the pessimism, when I heard 19/20 constitutional scholars thought Obamacare is constitutional, I had a feeling it would survive.

That may be true, but I didn't foresee him being the swing vote.

His votes on Tuesday were a hint. I didn't believe it at the time, but it held up. Pretty awesome.

LessO2: You KNOW Romney is going to beat his chest about Massachusetts health care law now.

Oh, and abandon his base?

HAHAHHA.....your move. Rmoney.

In a sense, the Court gave Romney no wiggle room.

Dare I say, the Court just trolled Romney and the GOP?

I don't have much of a political or legal opinion on the merit of the Court's decision, but I look forward to two straight weeks of hyperbole, insurrection bluffs and greasy moron tears.

Adolf Oliver Nipples: 2) The Congress could have saved themselves a lot of trouble by simply calling it what it is, a tax. It was always a tax, and calling it something else was always a big charade. We need to get over this tax-averse attitude we have in this country if we wish to maintain any semblance of the standard of living we currently have. We can't continue to live off of other peoples' largesse for much longer.

They could have saved themselves the trouble of it passing. If they had called it a tax, it wouldn't have received enough votes.

Teabagger's heads asplode from coast to coast. Pity the simple solution of either single payer or Medicare for all didn't get considered, but it's coming.

paygun: SphericalTime: Awwww. I was hoping for single payer during my lifetime.

I wouldn't rule it out. Single payer is going to be the reform for the reform.

I really,

really,

really,

really hope so.

But honestly just getting young adults longer coverage + working on the deny-due-to-per-existing-conditions BS were both good steps forward in the right direction.

Yankees Team Gynecologist: [farm3.static.flickr.com image 500x656]

I worked on getting support for the SCHIP expansion... goddamn. I'm not going to go over the stories (relating to SCHIP or just health care in general) because most of them are just too goddamn depressing.

But one is a good example:

Met a couple who had two young girls. Both were working for very little money and had no health insurance of their own, but the girls were covered under SCHIP (MIChild in Michigan). One was born with a nasty genetic condition (name escapes me now) that was controllable under constant care at least.

The dad had to keep turning down promotions at work, because a promotion would throw his income just high enough where his daughters would lose health care. Essentially a death sentence or at least miserable existence for the one, and an individual health care plan for her - if they could even get it - would be over $1,000 a month.

Considering mine from the same individual provider was $200 a month as a fairly healthy young 20 something who had been in the hospital once since the 80s, I could see that...

So they were stuck. The American dream, you know.

Thunderpipes: DistendedPendulusFrenulum: Thunderpipes: Weird, Obama stated over and over this is not a tax. Now he argues it is.

At least they shot down the forced Medicaid expansion. That will throw a big wrench into his plans. 26 states can tell Obama and the Feds to suck it now, and they will.

Still scary. Means Congress can regulate your behavior via taxes. Vote Republican? Obama can impose a tax on you. Buy an American car? Obama can impose a tax on you. Christian? Obama can impose a tax on you.

Now liberals, if we get a Republican advantage, how about we implement a tax on the unemployed? No job? Fine, pay a tax. I know you think you just won, but you just screwed everyone equally with another erosion of individual rights.

Congress levies taxes, not the executive, retard.

?

Obama controls his biatches, and you know it.

Still a loss for Obama. Can't work without the Medicaid expansion, and the states are pissed off and will not comply. Most Americans are against the mandate, so you just pissed off a bunch of people who are independents. He is a complete liar and flip flopper since he insisted this was NOT a tax. That will cost votes too.

Suck it, libs!

Obama controls his biatches? So sorry to hear of your trgic departure from reality.

.

The implications of this go far beyond health care - checks & balances, executive power, contract law, and so many more fundamental institutions are all in question now.

I am honestly shocked and completely dismayed by this.

Adolf Oliver Nipples: Three things:

1) Can we finally put to rest the notion that the Supreme Court was rigged for Republican initiatives? It's tiresome, and in reality the butthurt that usually comes from SCOTUS decisions is because it's your particular ox that's being gored, not because they're ideologically fixed and conspiring to fark Democratic initiatives.

2) The Congress could have saved themselves a lot of trouble by simply calling it what it is, a tax. It was always a tax, and calling it something else was always a big charade. We need to get over this tax-averse attitude we have in this country if we wish to maintain any semblance of the standard of living we currently have. We can't continue to live off of other peoples' largesse for much longer.

3) Congratulations to Barack Obama on his reelection. This essentially sealed the deal, the rest is just pro forma screaming.

First two points, I will agree with.

In regards to the 3rd point:

The court decision means it can be law not that it should be law, meaning this will drive the far right that wouldn't have been so willing to support Romney to the polls to both vote for conservative congressmen to vote to repeal it, and to vote for Romney to appoint more conservative judges should the need arise.

I don't think it gives Obama any sort of boost, but I guess we will see with any new polls that come out.

MasterThief: Silver lining based on SCOTUSBlog: The mandate was not a legit use of the commerce clause, but it was OK as a tax.

So yes, Obama and the Democrats did, in fact, raise taxes on the middle class. After repeatedly promising not to.

Except that the tax is only on people who don't get insurance. So no, he didnt' unless you think all or most of the middle class will refuse insurance.

If you mean he went with the mandate because it was a Republican idea, so it would have a chance of passing Congress; then yes, he meant that.

While I may disagree with you on alot of things, you have restored my faith in the court, which had been shaken as of late.

verbaltoxin: From the BBC:

1022: The insta-reaction begins: Matt Kibbe, head of anti-tax conservative Tea Party group Freedom Works, writes this in a fundraising appeal to supporters: "In a shocking and disappointing verdict, the Supreme Court upheld ObamaCare and its individual mandate as a tax, ushering in an unprecedented expansion of government power and handing a huge victory in Obama's Progressive plan to 'fundamentally transform America.'"

It's almost like these shills already have these talking points written out on their hands.

ialdabaoth: Ok, look. This is simple.

If someone can't afford to stay competitive, why do they deserve to compete?

If someone can't afford to keep working, why do they deserve to work?

If someone can't afford to stay healthy, why do they deserve health?

If someone can't afford to stay alive, why do they deserve to live?

You get what you pay for. If you can't afford to pay, well... I suppose it's polite to pretend that it was nice knowing you, but you aren't much use anymore, are you?

And if you disagree with all of the above statements, great! Politics takes money. If someone can't afford a lobbyist or a campaign, why do they deserve to have an opinion?

Thunderpipes: DistendedPendulusFrenulum: Thunderpipes: RolandGunner: Well, in the long run it's the best possible outcome if the law was going to be upheld. By changing the mandate penalty to a tax and, ruling out the commerce clause justification, the bill is upheld without issuing a blanket authorization for the federal government to force the purchase of goods and services.

But it just did. If Obama wants you to do something, you do it, or the feds tax you. That is force. Just wait until Pubs in the states start pushing something you don't like and enforce it with a tax..... Will you like it then?

Hasn't got anything to do with what Obama wants.

.

Either you are joking, or you are the lord of trolls.

Son, congress writes the laws and levies taxes. Thus, the entirety of your argument rests on fallacy.

17. Individual Mandate Excise Tax (Jan 2014): Starting in 2014, anyone not buying "qualifying" health insurance must pay an income surtax according to the higher of the following

90% of HSA plans will not qualify by the way. Remember when you could keep your current insurance? 14 million people use HSA plans. So over 12 million people will be forced to drop their plans or pay more just on that alone.

It is a loss for Obama, Vodka posting moron. He will lost millions of votes because of this. The Medicaid part screws his plans, and all America loses. This is bad news, for Obama.
