I was kind of hoping they would overturn it so we could work toward single payer health care.... oh well, watching conservatives have an epic biatch fit will be awesome any way.

2012-06-28 10:20:40 AM
Roberts basically said "It's constitutional, but we don't like it"

2012-06-28 10:20:43 AM
CNN: Correction: The Supreme Court backs all parts of President Obama's signature health care law.
LOL.

I hope someone grabbed a screen grab of that. It's our modern day Dewey defeats Truman.

VICTORY!

4.bp.blogspot.com

So, going into the election season with lots more pictures of stupid racists with idiotic signs.

Whee!

2012-06-28 10:20:49 AM

Phinn: bdub77: Roberts did not want to be known as the guy who took away healthcare from millions of people.

No, just their money.

Which is their labor and productivity.

You're pretty farking generous with other people's money.

So is the military.

2012-06-28 10:20:52 AM
Why are all of the leftists cheering for the mandate to survive? This is the part the Dems had to include in order to get Olympia Snow to stop filibustering! We should be rooting for the mandate to be struck down with the proscription of discrimination based on preexisting conditions upheld.

Are you people all nuts? You're rooting for a bunch of corporations to retain the right to ass rape us. There's a reason the health care industry doesn't want this law overturned.

2012-06-28 10:21:00 AM
Ok, given that the ruling says this was upheld as a tax, did they rule at all on if its a valid exercise of the commerce clause? Or did they decide they simply didnt need to address it at all?

2012-06-28 10:21:02 AM
So is this when we start the communistic fascist takeover?

am I not supposed to talk about that here?

Better than the alternative

/Still would have liked single payer

We'll get it eventually, I wouldn't worry.

ain't gonna happen now

topcon: That sucks, I liked watching various military forums bust people who were pretending to be veterans.

Well, they can still do that. Striking the Stolen Valor Act doesn't mean that public shaming is off the table. You can still fire people for lying on the job application... you just can't send them to prison for this particular type of lie anymore.

/Veteran
//Agrees with SCOTUS on Stolen Valor

2012-06-28 10:21:10 AM

Debeo Summa Credo: Wow. Somebody upthread called Roberts joining the majority so he could write the opinion. Good job.

A bunch of us did...I just don't think we expected Kennedy and Roberts to vote differently.

2012-06-28 10:21:14 AM

clovercat: Medicaid expansion struck down. Bastards.

The bottom line: the entire ACA is upheld, with the exception that the federal government's power to terminate states' Medicaid funds is narrowly read. That is, it's upheld, but the Secretary of HHS can't just strip all of the funding willy-nilly.

They should have just made it a tax discount for having insurance. I doubt there could have been any argument then.

2012-06-28 10:21:19 AM

Edward Rooney Dean of Students: Also, it means that the administration HAS to call it a tax" now. There's no way around it, and that's going to make it EXTREMELY unpopular in a lot of circles.

No they don't. Lying is constitutional remember? The judgement right before this one?

2012-06-28 10:21:19 AM

Weaver95: CNN is being stupid. MSNBC is saying that SCOTUS upheld Obamacare.

looks like i'm gonna have to listen to Limbaugh today then. he's gonna have a freaking meltdown over this.

Ooh, I don't know that that's a good idea. I mean, sure, a meltdown from a drug-addled fat man can be good, but it might not be good for your well being. Just be careful looking into that abyss.

One of my coworkers just announced the results, and is having a meltdown as we speak. Pretty lulzy.

2012-06-28 10:21:24 AM

chuckufarlie: Edward Rooney Dean of Students: OK, so if they're calling it a tax, would that mean that it could be ruled unconstitutional LATER, once it affects someone adversely (can't recall the term for that)?

taxes adversely affect everybody.

Except, of course, those of us who wish to live in a civilized society.

Jackson Herring: TimSTP: NBC: 'INDIVIDUAL MANDATE UPHELD"
CNN: "INDIVIDUAL MANDATE STRUCK DOWN"

Journalism!

CNN already changed it, my guess is they accidentally posted the wrong pre-prepared story and headline.

Somebody is getting reamed by his boss right about now. Heh heh.

Of course, the teabaggers are going to turn this into something stupid. "They got to CNN!" or some shiat.

Could this push Rush Limbaugh into cardiac arrest?

only if the alternative was "nothing at all"

That's more or less what the GOP is proposing...

Edward Rooney Dean of Students: Also, it means that the administration HAS to call it a tax" now. There's no way around it, and that's going to make it EXTREMELY unpopular in a lot of circles.

The law has been out for 2 years. People already have their opinions on it. A retroactive label isn't going to mean anything.

2012-06-28 10:21:36 AM

Weaver95: CNN is still confused....

I hope we get to see a picture of Obama holding up an iPad with CNN.com, a la Dewey Defeats Truman.

Tom:
Chief Justice Roberts' vote saved the ACA.

Robert's impressed me last year as a non-conservo-bot when he voted to protect workers rights to sue a corporation. He may end being a swing vote. Reagan and Bush Sr. both appointed what they thought were conservative justices that turned sensible, maybe this was Bush Jr.'s I have noticed that no liberal justices ever go conservative, but a few conservatives have slipped over to the liberal side.

2012-06-28 10:21:42 AM
Roberts pulls a Hollywood Hogan heel turn on the right.

Delicious!

"The court reinforces that individuals can simply refuse to pay the tax and not comply with the mandate. "

???
It's optional?

Edward Rooney Dean of Students: Also, it means that the administration HAS to call it a tax" now. There's no way around it, and that's going to make it EXTREMELY unpopular in a lot of circles.

Those circles being the circles that always hated it to begin with and would never vote for Obama.

"The court reinforces that individuals can simply refuse to pay the tax and not comply with the mandate."

Now THAT is interesting...

Don't mind the black van outside your house in a few minutes...they're just there to sell vacuums.

We saw the last time a Republican got mad in OKC.

Can we get a mod in here to keep these whackjobs in check?

fark you, republicans will eventually like this. Anyone really interested in freedom won't.

Well ok then.

2012-06-28 10:21:57 AM
Individual mandate will be upheld. Roberts regrets CU, and doesn't want to look stupid again. Plus, its a gift to insurance companies. Its like abortion: the GOP will make a lot of noise to rile up the base, but in the end won't touch it.

2012-06-28 10:22:01 AM

paygun: Well, taxes are constitutional. On the other hand, this kind of blows "I won't raise your taxes one dime" out of the water.

I didn't know Obama was on the SC. Sh:t, learn something new everyday!

The best Rove could do to spin it was " This decision does what the administration didn't have the balls to do and call it a "tax"

No, Blitzer just explained what happened...

Their guy in the room heard the CJ say "it is not valid under the commerce clause" and went instantly to it being struck down. He didn't wait for the "but, it is ok as a tax"

2012-06-28 10:22:30 AM

You like this government handout to insurance company CEOs eh?

2012-06-28 10:22:30 AM
Well this was interesting...it's withing Congress' power, but it's not... well at least Obama can claimed he got something big out of this.

And now, there probably will be conservative tears in this thread. It's he Walker recall all over, this time with positions switched.

Well my liberal friends (who I don't actually know), I hope you're thankful for Roberts on this one. You get your healthcare after all :).

Edward Rooney Dean of Students: Also, it means that the administration HAS to call it a tax" now. There's no way around it, and that's going to make it EXTREMELY unpopular in a lot of circles.

Amy Howe: The court reinforces that individuals can simply refuse to pay the tax and not comply with the mandate.

No, there is absolutely a way around it. Set your withholding so that you do not have a refund at the end of the year. They can't do shiat to you then.

2012-06-28 10:22:36 AM
America, you actually got a decent outcome and the system didn't colossally fail!

Can't say the same for Citizens United... but there's a legislative solution to that one.

2012-06-28 10:22:40 AM
I like that this massive victory for Obama is supposedly a death knell for his reelection.

Good luck with that narrative.
