While I will certainly opine that the mother is a moron, I don't see this rising to the level of a criminal charge. It was a very stupid thing to do, and only through luck and the prodding of people not nearly as stupid that the children were unharmed that it does not meet the standard to prosecute.

However I can only hope she has learned a valuable lesson.

It isn't hard to imagine that leaving small children in a car in sunny 88 degree Florida weather for more than 20 minutes could endanger their lives.

No it is not, that is why I said she is a moron.

Luckily someone with more sense than she told her she was baking her children. However without any medical treatment the state is going to have a tough time prosecuting this. If she wants to go to trial I don't see a conviction.

She probably wouldn't do prison time, but she would probably get probation for child endangerment. Keep in mind the youngest child was 1. older children in a car MAY not be an endangerment issue (if they're old enough to know how to leave the car and find mom). But 6, 3, and 1 years old? Young kids have strangled themselves on power windows and started cars and back into traffic and all manner of stuff.

Like I said, she probably wouldn't go to jail, but she'd probably get probation and have to take a parenting course before she got her kids back.

This is why I could not be a cop, I would have the urge to tase her, lock her in the trunk, get the kids to the ambolance(sic), and leave the car in a sunny field for a few days before remembering where she went.

Hee in Texas it is against the law to leave any child < 15 years old in the car, unattended, for more than 5 minutes. No "proof" that "harm occurred" necessary.

I'll be the first to say that "news" rarely gets the story right (no fact checking or follow up; rush to scoop; presenting a non-story, etc), so take this story with a bolder of salt.

I've seen this happen twice when I was stationed in Texas. 100+ degree temp, kids locked in the car in direct sun while the Parents Of The Year are in Wal-Mart shopping.

You'd be amazed at how much property damage you can get away with by telling a 911 dispatcher, "I'm a combat medic. The kid appears to be in distress, I'm knocking the windows out. Send an ambulance."

Um, anybody interested in the facts of the matter?

I live a couple miles from where this happened. TFA states that it happened on Tuesday morning. Well... on Tuesday morning, we were still getting rained on from T.S. Debbie, and the temps were in the mid-70's here. Repeat, mid-70's here. These kids were in no real danger from heat. The afternoon high was about 85 in Tampa, but about 80 degrees here.

Yes, they've criminalized leaving kids in cars unattended, and for some very good reasons. But the kids in this one particualr case were not going to suffer. The windows were up because it was raining and very windy. IMHO, leaving the windows down would have been child abuse.

She was arrested, and will have to face the consequences, but the kids are just fine except that they are terrified about having their momma taken away. After the rough treatment from a southern judge, this gal won't be doing ths again any time soon.

you and me both. i used to watch 'Cops' on TV. could not farking believe how some people would be yelling and screaming right in a cops face. there is a lot of people that seem to not know how to behave like an adult. screw that noise, that's a miserable job not fit for most.

These things are grey, and law enforcement generally treats them as grey until local media gets involved, and then they get all enforce-y about it.

The numbers aren't huge, ~500 kids dead since 1998 (and that's for the whole US, not just Florida). But of course kids can't defend themselves from parental stupidity, so if you don't have a law combined with disproportionate media attention then I guess you end up with higher statistics.

People are idiots. (shrug)

Those people only actually care about fetuses, not kids. The same people who are anti-abortion also want to remove any kind of safety net, which tends to disproportionately effect poor, single mothers.
