So the guy was harmlessly toking up in his own home? Nowhere near children? I don't see what he did wrong.

Also, I need a justification for why THC is considered schedule 1 but Marinol is schedule 3

Delivery of a controlled substance? You mean he partied with some undercover cops. Big flipping deal. This guy had a healthy stash but there is no clear indication that he was dealing. I bet he was simply trying to get his stoney arse laid.
