5.- As usual, "the Internet" has passed judgement and decided this FunnyJunk guy deserves his life thrown in a blender. Because nothing is more right than an "Internet" posse. And I use quotes because it's not really the Internet, but the same bunch of manchildren who's always involved in this kind of stuff and "Operations". (Yes, they love naming their hissy fits as "Operation [Insert something stupid]". Should tell you the level of maturity we're dealing with here...)

What's amazing is that most of the internet hadn't heard of theoatmeal before this lawsuit or maybe they had in passing. Most had heard of funnyjunk because of their crappy ads, I have been there once and it sucked so I just wrote them off because of their shiat site.

Ironically this lawsuit seems to have driven more users and advertisers away than anything theoatmeal did and you can bet theoatmeals traffic has tripled.

Ignoring everything else you said, you understand that Inman's content is his business, right? I don't care what he does, telling someone to take it as a badge of honor that somone is stealing his product and making money off it is flat out being an asshole.

I didn't know Carreon had been a bully and sent his goons first, which effectively puts him in the hot seat. Thankfully mjjt told me about it.

One sad facet of this debacle is knowing that sites like the Oatmeal and FunnyJunk could have a mutually beneficial relationship. If FunnyJunk would attribute the works to the original author and provide a link to the site the author would get more traffic and likely not object to his content on their site.

Carreon is really suing because Oatmeal never sued FunnyJunk, thus depriving the ecosystem of lawyers of their income. This should have fed an IP lawyer's cocaine addiction for at least a week, but he stole that cocaine right out of some lawyer's nose.

One should note this case would have been open and shut in the UK in favor of FunnyJunk. Making an honest and true complaint can get you sued for libel out of publication in the UK.

If you're comparing this case to common internet piracy you're more out of touch than everyone else seems to think you are. Some pothead downloading a movie or TV show is not the same as one website taking content from another, removing any link to the original or even any credit to the creator, and then hosting it on their own website while making money from the ad-revenue that it generates. Granted, they're both acts of copyright infringement, but they aren't the same thing.

That is pretty cool - I particularly liked the bit where he said that funnyjunk may not qualify for DMCA protection (a website isn't liable for copyright infringement if it takes down stuff as soon as notified) because it doesn't seem to have complied with the DMCA rules.

/does this qualify as irony or schadenfreude?

for arguement's sake, in the brick and mortar world, if someone "hosts" your content o something like a news stand, the conent provider gets paid one way or another.

if the same content provider has his/her material on something of a more comparable model- like a news paper (pays others for providing content, gets paid via advertisement/subscriptions), they get paid or sued.

why is it allowed to be different on a website?

and, if it is to be continued, have everyone with copyrighted materials demand a share of gross income based upon space occupied/views in exchange for not going to court.

Since you seem to have missed the point completely

1. the oatmeal supported (a) because he seems to be in the right since it was his original content that was purloined and (b) because he provided a witty response to the lawyer (well it appealed to our juvenile sense of humor, anyway)

2. the lawyer opposed because his letter appeared to be licensed extortion

Is That So?

The Zen master Hakuin was praised by his neighbours as one living a pure life.

A beautiful Japanese girl whose parents owned a food store lived near him. Suddenly, without any warning, her parents discovered she was with child.

You're dialog significantly misrepresents the sequence of events.

Fair enough so far... but allow me to make some modifications for the rest:

OM "It's not worth my time to pursue the issue in a court of law. I'm not happy but I'm gonna let it go."

... One year Later...

I don't think the charity is material. The real issue is the extortion. You can say that FunnyJunk is providing a service to their users that want to host stuff on a website. I think there is room for a real debate about what the rights and responsibilities are for content creators and content aggregators. But the clear wrong was the predatory behavior of FunnyJunk and their lawyer.

FJ: "Pay me $20K or I drag you into court and make your life a living hell through years of litigation!"

Oatmeal started in the right but then went about it wrong. From everything I've seen dude has a pretty good case as long as he kept records of the shiat he made and when and when it appeared on FJ and kept records of takedown notices sent and the lack of response by FJ. With all that he could have gone to a lawyer and either sued for copyright, or leveraged FJ into a sharing of advertising profits for ads that appear on his material that shows up on FJ.

Instead he acts like a douche, does his bit with the cartoons poking fun of FJ and puts himself in an tenuous position. I can't say I blame him for it, but I also can't blame FJ for trying to take advantage of the stupid way Oatmeal handled shiat.

And it's funny because I so often see the majority of folks here on Fark jumping on people's case for going the revenge route instead of the smart route. Yet here we have someone going the revenge route instead of the smart route and Farkers are jumping to his defense.
