theorellior: Carth: This tech dirt article goes into more depth about the lawsuit and parties involved.

It's interesting that the site mentions that FunnyJunk has DMCA protection because they're a registered site. They also say that to be a registered site you have to have a registered agent and respond to requests to take down copyrighted content. They obviously haven't taken down copyrighted material. Doesn't that negate their DMCA protection?

As far as I know Oatmeal is just one guy. He probably doesn't have the resources to watch Funnyjunk and all the other sites rehosting his content.

The Popehat post has a quote from Marc Randazza that made me giggle like a nine-year-old who just learned the word fart:

Despite my earlier charitable comments, I can not find any words to defend trying to shut the fundraiser down. I can't even gin up a minor benefit of the doubt on that one. I can see an ill-considered demand as a mistake in judgment while hoping to gain an advantage for your client. But taking a shot at the fundraiser would not do that - it would just be lashing out to hurt bears and cancer patients? Holy farking shiatballs inside a burning biplane careening toward the Statue of Liberty, Captain! I hope that the reporter merely got the story wrong, because if not, that's more farked up than a rhino raping a chinchilla while dressed up in unicorns' undergarments.

Just because YOU don't know about The Oatmeal does not make the site unknown.

Also, you're reading compherention seems a little off. "The Public" is not paying any legal costs for this, The Oatmeal responded to the treat to sue by holding a fundraiser to split the proceeds between two charities.

The Oatmeal was so unknown it managed to hit it's 20K goal in under an hour.

Sometimes being on Fark makes me think I have a finger on the pulse (along with that finger in your mom).

-The thread with the live play-by-play of someone's beautiful Russian cousin about to get caught up in a Brooklyn based human traffiking thing.

-The archived 9/11 thread where everything unfolded in real time even while the big news broadcasts were blown out in the city.

This thread, and everything in between. I could care less about Caturday or 70% of the links, but every once in a while a good one shows up where you can either learn about news as it's happening, or simply watch someone's reputation writhing in quicksand such as this instance.

Thanks Fark!

SlothB77: who? what?

There's this online comic artist (The Oatmeal), and this other website (FunnyJunk) wants 20 grand from him. The other website is a place where people go and post funny pics of stuff. The comic artist noticed that nearly all of his artwork was posted over at the other website, unattributed. He didn't do anything legal about it, he just complained online that FunnyJunk was making money off of his work. A year later, the comic artist gets a letter from FunnyJunk's lawyer, saying that if the comic artist doesn't give them 20 grand and doesn't remove the complaints about FunnyJunk from the comic artist's website, then FunnyJunk is going to sue him in federal court for defamation.

So the comic artist consulted with his lawyer, and obviously his lawyer told him that they're full of shiat and feel free to tell them to suck your balls. So the comic artists says, "I'm going to ask people to donate 20 grand to this new fundraiser of mine. All donations will go to the Wildlife Federation Fund and to cancer research. If and when I get the 20 grand, I'm going to take a picture of it and send it to you, along with a picture of your mom trying to sex up a bear. And that's the closest you're going to get to 20 grand from me."

And then people have donated over 100 grand to the fundraiser so far. So it will be kinda cool to see a picture of a lawyer's mom trying to sex up a bear on top of 100 grand.

Every pathetic person here calls any post they don't like a "troll".
1. There is no opinion or position on earth that some percentage of people won't have an opposing viewpoint on..It isn't ALL "trolling", it's a world filled with different people, with different viewpoints on things.
2. the definition most of you imply on "trolling", is that it's a disengenuous post designed only to elicit a response. As such, a troll post that is completely ignored we correctly be scored 0/10. Any response implies the "troll" was successful, rating at least a 1/10

3. I really can't understand why so many people are so into an internet pissing contest between some guys' blog and some even shiattier "humor" site. The fact that the defense of said blog is so nearly unanimous and passionate is mystifying to me.
