She could have forced him to use a condom. "No glove, no love for you sir".

If he wanted to fark her that bad, he would have put one on.

Mydoom was a worm. If someone gave me genital worms, I'd probably sue for more than a million dollars.

So how do you go about proving something like this?
And isn't this an inherent risk with...uhm, the activity?

This works both ways you know.

You'd think that a pro who uses a dental dam would insist on a condom.

She's an anti-dentite and wants them to have their own schools.

Oooh....depending on whether the dentist was in or out of network, she may have a huge copay for the "acquiring the herp" service.

Every time I sleep with someone, I'm sleeping with everyone they've ever slept with. It's exhausting just tracking them all down much less banging them, but it's my policy and I'm sticking to it.

Later, while the two were lying in bed, the man told the woman he had herpes, Vogt said. She asked him to leave.

Sounds like she did:
The woman, who filed the case under a pseudonym, testified that she asked her date to wear a condom and he said OK, but the next thing she knew he wasn't wearing a condom and it was too late.

Apparently, he Assanged her.

Condoms don't necessarily protect against herpes. Sadly, a similar incident happened to a relative of mine. She dated a guy for just under a year. They went to church together. Shortly, after the first time, she developed symptoms. He actually said to her, in front of witnesses, "I didn't tell you because I love you and I was afraid you'd break up with me."

He was a real winner. Once, she brought him to a funeral that I also attended. After the service, I glanced around and he was standing on flat-style headstone. No kidding, he was just standing on the grave marker, hands in his pockets, looking at ease. I started to march over there, but one of my older sisters' beat me to him.

They are no longer a couple. Unfortunately, my relative can't break up with herpes. It never occurred to her to sue.

condoms don't prevent transmission of genital herpes. they cut the risk of transmission of course (by 30% or so), but if the area of viral shedding at the time (you don't have to have a visible sore) isn't covered by the condom, the risk of transmission greatly increases.

She didn't consent to sex without a condom. She handed him one. He didn't put it on.

Further, condom or not, he didn't tell her he had the herp until *after* sex. That denied her the right to make a fully informed decision about consent.

In summary, fark this guy.

i'm not denying that he isn't an ass, but I still don't see how she deserves $1 million for this.

why didn't she stop when he refused to put the condom on? that should be a gigantic red flag and she should have sent him packing then.

One thing I wasn't 100% clear on...

The dentist paid the $, right? If the dating site did, that's complete and utter horse plop.

If the dentist did, yeah, suck it up. Not literally.

Maybe literally.

Is that poor cemetery etiquette or a type of superstition? I've only heard of it once before from a really old guy who yelled at a kid for standing on a similar marker saying he was standing on the deceased's head. Sounded weird to me but since you've also mentioned it, guess there is something to it.

I don't agree w/this. The guy is a douche and probably deserves an ass beating, but it's a risk you take when you have sex w/someone you don't really know. It sucks but that's the reality of dating and farking. Also, she couldn't tell he wasn't wearing a condom? Seriously? She should've told him to stop if he wasn't wearing one.

I'm not sure how old you are. Hopefully, my standard monologue won't be inappropriate.
You should still use them though when you decide to go there. But, don't go there too soon. Wait, wait, wait. Consider waiting until you are married. Do not rush yourself or anyone else because it's a huge responsibility. And do not do "it" with anyone you would not want to be the mother/father of your child because birth control is not 100%. So, if you meet a hot person and thing "Wow, s/he would make an awful parent, but s/he is so hot." keep walking. The earth is jam packed with people. You'll meet someone else. When you meet that someone, (maybe at age 25 or 30) unless you are married and planning for a child, go double dutch, use birth control: two kinds because sometimes one method will fail. Relying on a single form of birth control is fine as long as you are prepared to care for a baby if that sole method fails. Did I mention sex is a big responsibility and you will want to wait?
Jeepers, I hope I didn't leave anything out.

My kids just turned 13 and 12. I may request a valium prescription.

It's extremely poor etiquette. It is highly disrespectful to the deceased and his/her family.Do not do it.

I've always heard it's disrespectful to the dead to step on or over a marker. Same with climbing on sculptures in cemetaries.

Oh, and unless you really want to piss people off, feeling up and/or making out with statues of Mary is also not something you should do.

It's common sense, just simple ordinary common sense. Certain places are for standing and sitting. Gravemarkers and places where people have been "laid to rest" are off-limits.

Same reason most know not to have sex in an elementary school, not to masturbate in the church pews during mass, and not to urinate in the foyer of a house.

If you disagree, perhaps you have a fine album collection or entertainment center I can take a shiat on and toss in a pool? I mean, unless you're superstitious or something.

The dentist's attorney, Shawn Lillegren, argued that the woman was negligent because she did not demand that his client wear a condom. He also portrayed the woman as greedy in his closing argument to jurors.

"Go for a million - that's plaintiff's message," he said, according to The Oregonian. "God bless America. Go for it. Got some coffee to spill on me?"

What an Asshat. If douchebags in his profession didn't hover around ambulances like vultures to a dead body we wouldn't have frivolous lawsuits in America.
