Yeah, but typically when a jury deliberates for nine days and comes up with one acquittal and hung jury on five counts, doing the whole thing over again will usually result in more acquittals or yet another hung jury. Depends on the vote. If it was 11-1 in favor of conviction, that's one thing-do it again. If it was 1-11, or even 7-5, there's probably no point in a retrial.

Anybody know what the vote count was?

It's not illegal as long as the money you are using to do it doesn't come out of your campaign fund. In this case they couldn't prove that it did, in fact all evidence pointed to it being a gift to him that was separate from donations into his campaign fund.


I haven't really followed the case - but couldn't you also point out that since hiding her was crucial to his campaign - accepting such a large gift violated contribution limits?

I mean then anyone could begin gifting politicians large sums of money and hiding it through clever ways. Slippery slope.

They had to prove intent, and prove it beyond a reasonable doubt. Sometimes friends just do things for each other, and sometimes it's for dishonorable but legal reasons like hiding a mistress from a hysterical shrew of a wife.

Nope because it didn't violate any law and saying what you are saying is a stretch that even Stretch Armstrong would have a hard time making. Plus the person who gave him the money paid a gift tax on it. So they would have to prove that the money went directly to his campaign activities, and hiding a mistress doesn't count.

In 2008, he scored a whopping 4 1/2 delegates.

ongbok: I figured if the jury could separate his behavior as a husband from what they were there to decide he would be acquitted. After all the facts are that the Bunny Mellon chick gave the money that this whole thing was about to him, and she even paid gift taxes on it, not his campaign.

Unfortunately not all juries are that smart. Hell, an alternate was flirting with him in the courtroom, practically stripping! The jury loved him. I knew how this would go when I heard about the alternate and also too by how long the jury was taking to come back with a verdict. When a judge has to ORDER them to come to a verdict, it does not look good for prosecution. Sorry.
