Palm Beach.

They can't seem to measure or count anything correctly down there. Votes, BAC....

I understand the debate against the use of breathalyzers and the possibility of them screwing up and know that blood tests are far more accurate. But that being said, what are officers supposed to do on the side of the road. Yeah, they can do all the roadside sobriety tests...but if the officer is still unsure, what can be done? You cant haul every person you pull over to the police station for a blood test...

Ah.

So 93% of Florida got DUI's and were tested on a single machine subby?

/that sounds like way to much work for the cops.

By the time they get to court, they can. An arrest is not a conviction.

If we are going to have an arbitrarily low limit for a DUI, of which being just a tiny percent over the limit makes you guilty, and extremely severe penalties like a DUI carries, it is reasonable to require the machine that gives that test to essentially be flawless.

Anyway, you can still be charged with DUI\DWI without a breathalyzer. It is why they record everything these days. I rolled up on a checkpoint last winter for the first time in years. The cop asked me if I would do a few tests (I was not drinking), and I said I'd happily take a breathalyzer if it would save us both some time. He said I still had to do the tests, and then they would decide if they wanted me to blow. I got to talking to him about it while I did the whole follow my pen thing, and the jist of it is a breathalyzer is just like the nail in the coffin of a DUI charge. They almost never show up to court with just that.

I do not even think Florida is in the top 10 states as to DUI/DWI arrests (per capita). I think North Dakota is number 1.

Counter_Intelligent: An arrest is not a conviction.

True, but it is a massive pain in the ass for all parties involved. Not to mention, it would be terribly inefficient.

Guilty until proven innocent, individual's judgement, mandatory tests that can't be waived most of the time. There was a point where Clay County Sheriff's department decided that just because you only have one leg doesn't mean you can't walk the line.

The cops modified a breathalyzer without following the proper protocol to make sure it was still calibrated correctly and continued to use it.
