Hey, I'm I think I'm beginning to see an underlying theme or motif for this election cycle.

Think it's pretty clear now that Obama going all pro gay marriage after the election wouldn't have worked.

That's not gonna be slid into a bill at the last second and fly.

This is a battle that needs to be fought and it's been a long time coming.

It's a war they want?

I'm cool with that.

We got history, morality, evolution, practicality, humanity and decency on our side.

What they got?

When I moved here to Seattle a few months back this cute co-worker decided she had to take me there before catching a midnight show at the Egyptian on Capitol Hill. Her reasoning was "You need to know what it's like to have put Dicks in your mouth"

DOMA will be resolved in the Supreme Court, because it says a same sex valid marriage in MA is invalid in NC. This contradicts the full faith and credit act in the Constitution.

Congress in 1996 passed the Defense of Marriage Act (110 Stat. § 2419), which defines marriage as a union of a man and a woman for federal purposes and expressly grants states the right to refuse to recognize a same-sex marriage performed in another state.

That's not a slam-dunk argument. Legal scholars disagree on whether that part of DOMA is unconstitutional.

Full Faith and Credit shall be given in each State to the public Acts, Records, and judicial Proceedings of every other State. And the Congress may by general Laws prescribe the Manner in which such Acts, Records and Proceedings shall be proved, and the Effect thereof.

The part in italics is what makes it so iffy. Basically the argument is Congress has the power to regulate full faith and credit. Using that power, Congress enacted DOMA, which says states are allowed to decide if they'll recognize gay marriages from other states. This is not the part of DOMA that Obama has stopped defending.

The other part of DOMA is ridiculously unconstitutional. It's the part that says that even if a state allows gay marriage, the federal government won't recognize it. It obviously runs afoul of the 14th Amendment. This is the part of the law the Obama administration is no longer defending.
