At any rate, he got busted because he left without paying for it; using your pockets (or pants) to hold groceries while you are in the store is not illegal.

Technically neither is opening a package and eating from it, so long as you pay for it before you leave. My wife does this all the time, and it bothers the hell out of me. She can't do it in my presence. I also was mortified the time she tore a page out of a magazine at the store because she wanted to show the picture in the ad to her hairdresser but didn't want to pay the $8 for the magazine.

eating something and having them scan the empty package so you can pay for it = not stealing...in states i've been in and worked in...i'm told in some places putting things in your pocket or opening packages IS theft. i worked security at a target in arkansas and we were told if we saw someone stick something in their clothing to keep an eye on them in case they left without paying, but it wasn't theft till they walked out the door

ripping a page out of a magazine without paying for that mag = theft, although i can't imagine most authorities coming down too hard on ripping 1 page out of a mag...maybe make her pay the $8?

there have been plenty of times i've gotten deli food at the grocery store and eaten while shopping and had them scan the barcode on empty packaging on my way out
