The person who wrote the article is an idiot. He linked to another article that supposedly supports his belief system and in it, the writer shows he has no idea of what Creative Common License is.

The Doctorow that tours as a poster boy for Creative Commons licenses that allow photographers' work to be used without permission? The one that "rips off" photographs for his own articles?

That is the key line in the article. Warning your users of imposters who do not have your track record or possibly the best interests of said users in mind is a far cry from a case of "what's good for the goose".

Let's look at the blog post that the "story" references:

A lot of proxies in support of TPB are popping up, which is a good thing.
Yep, they shure are butthurt about it.

We've noticed at least 3 sites that are tricking users to buying access or similar. We do not condone this behaviour, The Pirate Bay is a free service!
So they only have a problem with proxies charging for what TPB provides for free.

We'd want to encourage you to look for a reliable source on where to find a good proxy that works for you. The people at TorrentFreak usually have a good list of updated proxies.
You mean they are actively encouraging users to find sites that use their work? Many they are pissed about copycats.

And if you can reach our original page, you should use that. It's always the safest thing to do.
OMG, they are just trying to protect their users and their reputation. How evil.

I don't think you understand the difference between copyright and trademark. One presumes control over people's thoughts and actions while the other deals with trust and validity.

In simpler terms: Copyright is exactly like me telling you you can't put a stick in "my" fire and "steal" "my" fire as if I had a right to prevent you from doing so. Trademark is exactly like me telling you you can't go around impersonating me in order to deceive others.


What these Pirate Bay impersonators are doing is using trademark infringement in order to lying to you so as to trick you into paying them, downloading infected software, etc.


Of all "intellectual property" laws, trademarks are the only reasonably good thing because they deal with protecting everyone from deception, whereas copyright and patent laws deal with protecting only one person's best interest at the expense of society benefiting from that thing.

Fair assumption, but incorrect. I don't infringe others' copyrights (so no downloading from Bittorrent or Rapidshare, etc.). I don't have any opportunities to violate patents or trademarks, but I wouldn't if I did. I don't do these things because I do respect the property rights of others. You can own a copyright, a patent, or a trademark. If someone infringes or violates one of those, they've broken the law.

All I'm saying is that it's impossible to own an idea. That's what the notion of "intellectual property" entails. This is too fine a distinction for most people, which is unfortunate.

The only copyright law I ever break is the DMCA, when I make backups of things I've bought (movies, music, etc.). This entails circumventing DRM, which is against the DMCA.

Always check the comments to see if that particular torrent is being "watched" by an IP owner. More often than not, if someone has gotten a letter from their ISP about the "Millenium Digital Copyright Act" and that they could face legal action if they continue violating it, they'll post it in the comment section for that torrent.

Do it the way that music has been created for thousands of years before the technology existed to record it (and thus to have "laws" about who can copy the recordings) -- charge people to hear you perform it.

If the government gave me a monopoly on the sale of something, I'd make a lot more money than if I had to sell it in a competitive market. However, the fact that I'm going to make more money with a monopoly does not justify the monopoly.

It's not the government's job to make sure your business model is profitable.
