The "oh shiat" isn't the main issue -- it's not even remotely important given the balance of her conduct -- they just threw it in the disciplinary complaint because she's a pain in the ass and the judge doesn't like her.

I've cursed on the record before (in federal court, which is far more formal than most state courts). Most attorneys have. The trick is to use only a word that the judge has already used on the record during the same hearing. Well, that and you have to have a rapport with the judge and it has to fit the tone of the hearing. But it still happens all the time during hearings (not trials).

Agreed. The Illinois ARDC doesn't give a sh-t about the cursing, but it may provide more colour for the complaint. I've cursed countless times in hearings here in Cook County. Even in trials, it's not necessarily an issue as long as its during a sidebar or during a bench trial (i.e., as long as it's not in front of a jury).

I had a law school dean who insisted that attorneys never curse and are rightly fired and disbarred if they break that taboo -- however, apart from a few years in a political appointment lawyer job in a federal department headquarters, he had never been out of academia and didn't know sh-t from shinola about anything beyond legal theory (and the longer I've been out, the more tenuous even his theories look).

Mind you, there are a few states in which the disciplinary body will impose discipline if someone complains that you used foul language, even outside of court and not directed at anyone. So be careful, Oklahoma lawyers.

Absolutely. Legal hearings, especially in criminal and family court, can get very heated. The issue really comes down to the judge though, as they have carte blanche over how they handle the attorneys in their court room.

If the attorney has given the judge problems over a period of time, then it could definitely become an issue.

I think the problem here is the attorney lying about it after the fact, not to mention some ambiguity with her statements regarding her client.

I think it was the "whatever" that got me.

Careful folks. If all attorneys were wise and reasonable we'd settle most cases with a phone call and never be able to afford our luxury cars. Joking aside, I find that clients usually look a lot like their lawyers and vice versa.

Came in here to say this. Cursing is no big deal. But lying to the judge about what you said, that is a huge deal.

With every (and I mean EVERY) court summons I get (at my old addresses) for jury duty, I tell da judge: FU*K YOU! Judges can kiss my ass, die & go to hell.

There are a lot of stupid lawyers out there. I'm surprised some of them managed to get their shiatty undergrad degree, much less a law degree. But that's the seldom spoken truth of law schools. There are so many diploma mills out there that anybody willing to pony up the money can get in somewhere. And with the exception of Cooley and some other bottom rung schools, schools do not fail people. So if you can get into a law school (which is easy enough), and you can manage to show up for class, you can sit for the bar.

I can't think of the last time I've head someone swear in Bankruptcy but I have heard the occasional slip in District.

What I have seen are some incredible dress-downs by judges at both levels. Well-crafted and witty.

One from a couple of weeks back:

COURT: Mr.X, you have successfully wasted 2 days of the court's time and we are no further along.

Mr.X: Your Honor, I think

COURT: I don't think, I KNOW you have wasted the past two days of my time.
