Not if he chugged them right in a row, then took off about an hour later. IIRC, each beer can raise your BAC by about 0.04.

Its all about timing. Like someone above said... its just not the amount alcohol, but also how fast you drink it. Remember, your body gets rid of the liquor slowly. Pace yourself, and you'll never be too drunk... no matter how much you drink.

Its all about timing. Like someone above said... its just not the amount alcohol, but also how fast you drink it. Remember, your body gets rid of the liquor slowly. Pace yourself, and you'll never be too drunk... no matter how much you drink.

That's why, using the math I mentioned above, I just get up to 2 drinks, keeping me just under the legal limit. Then, I pace myself with 1 drink per hour. This way I never go over & I'm safe to drive home.

Kidnapping would impart no wrong-doing on the other guy's part. I think this qualifies more as a citizen's arrest, as the first did see him commit a series of felonies. The guy admitted at his house to committing the crime; the witness would not need to wait for police at that point to take him into custody.

WTF is so hard about not driving if you've been drinking? It doesn't matter whether or not you're driving within legal BAC limits, just don't drive if you're drinking. Walk. Take a cab. Have a friend be a DD. Take the subway/bus.

The way some people cling to their "right" to drink and drive, it seems like they'd rather give up a limb than be stopped from drinking their alcohol and then getting behind the wheel.

I only have a GED in law, but isn't it citizen's arrest? He watched the guy commit a felony.

I may be wrong, but I think the limitation is that you don't get to take people you arrest under a Citizen's whereever the hell you feel like. I'm pretty sure that is just kidnapping.

On the other hand,a car did a hit and run on a cyclist in Oakland,California who happened to have a handlebar camera. Cyclist was ok. Turned out the driver was a parolee packing heat and drugs when the Oakland PD caught him.

Witness had lawful excuse to take and transport the offender, and then brought the perp straight to police. Had he taken a long route, or back to his place for a good beating first, or anything else, kidnapping could be brought up.

Just cause the guy didn't want to be taken does not mean he was kidnapped. And it wasn't wherever the hell he wanted, it was straight to the police.

A big burly guy had a skinny black kid in a submission hold and the kid was screaming bloody murder. The guy had flagged down the bus and asked him to call the cops as the black kid had tried to steal the guy's son's bike right in front of both of them. He had snatched the kid off the bike just a minute before. The guys kids were standing around cheering for Dad.

Depends on what kind of beers he was drinking. For one thing the draft beers at a tavern are probably 16 ounces or more, it's also possible they were higher alcohol beers. 6 beers is enough to get you smashed if they're the right kind/size.
