You missed the step where she goes to the DMV and presents her proof of citizenship, gets her license, then decides not to carry it with her when she's driving around.

So of course she's going to use public transit for everything in her life, what with Phoenix's awesome subway service.

Exactly, can't come to the country legally, just come in illegally. Can't get a driver's license, drive anyway. Can't get a job, steal someone's identity.

Illegally driving without a license has such a huge upside with the downside being a game of very rare russian roulette. I can't stand unlicensed drivers, and uninsured ones. That's why I think they should allow anyone to get a license, citizen or not.

I'm not saying driving without a license is right. I hate it when people do it. But I understand why people do it when it is impossible for them to get a license. Modern American life is built around a car.

Aren't there mechanisms in place for situations when a citizen marries a non citizen?

They were married years ago......way to procrastinate....of course its all Arizonas fault and not the lazy illegal immigrant who tried cutting through a parking lot to avoid construction traffic.

saintstryfe: The article isn't clear: Does she not HAVE a driver's licence, or just didn't have the physical card on her?

She didn't and according to Arizona law, she can't get a driver's license until she's a citizen.

Okie_Gunslinger: Okay I'm not real up to date on immigration procedures but the article says that they have been married for 4 years, does it really take that long to get citizenship even if you are married to an American citizen? If she didn't have a Drivers License she probably wasn't covered by the cars insurance either, if that is the case she got what was coming to her. Uninsured drivers tick me off.

My friend has been trying to apply for citizenship legally for the past 5-10 years. She has had her green card the entire time. She's a nineteen-year-old college student with straight-A grades and plans to research cures for malaria.

It really is not as simple as it sounds, which is probably why FTFA's woman didn't have a license. She was a competent driver, but couldn't get the little card saying that because of legal issues.

Also, as another Farker was kind enough to point out, this is a big deal because a young child was left with both her parents gone for no good reason. And unless it's murder, child abuse, or some crime on that level, it is not a good reason.

2012-05-04 12:50:29 PM
tenpoundsofcheese: If she is "working on getting her US citizen" than she should have some legal paperwork that demonstrates that and this wouldn't be an issue, right?

Do you carry around paperwork proving you're a citizen? Do most people in the U.S. do that? Does the average person working towards getting citizenship carry around their legal papers?

You know, it's pretty hard to garner sympathy here. I see a lot of poutrage and a lot of derp. Here's one:

Green said her detention runs counter to an immigration policy the Obama administration introduced in 2010 called "parole in place," which allows illegal immigrants who are spouses, parents and children of American citizens serving in the military to complete the process of becoming legal residents without having to leave the U.S.

It runs counter? Did they force you to leave the US? Or perhaps is your sob story not so sobtastic? What else is derptastic here?

On a semi-related note, why hasn't there been a Fark thread greenlit about the JT Ready shooting spree?

I have been wondering the same thing.

I was curious about it, too. It was so weird to see that fat f*cking nazi on my TV again, especially given the strange circumstances surrounding the occasion.

Been following it on infowars and other such sites. Apparently, 0bama is slowly rounding up dissidents and assassinating them, with the help of Eric Holder and MS13. Once the infowarriors get to the bottom of it, I'm sure a thread will show up and the usual trolls will be along to point out how we are brainwashed into believing everything we are told: "Break free from the mob. I alone am best: I do have a question though about this whole situation. For cases like these why is the immigrant not given some sort of ID during the process that keeps things like this from happening?

She had a military spouse ID.

Showing that should have prevented her from going to ICE to start deport proceedings but there is a he said/she said component here.

fta: Trish Carter, a spokeswoman for the Mohave County Sheriff's Office, said there was no indication in the police report that Sanchez showed her military spouse card. The deputy "followed standard procedure" in turning her over to the Border Patrol, Carter said.

She says she showed it, cops claim she didn't.

I find her claim more credible than the cops on that but I'm still a bit leery of the idea of someone driving without a license or insurance.

/And yes, I realize why that is, just sayin'.

Bottom line?

Worst. Birthday Party. EVAR.

My neighbor (a naturalized citizen) tried to get her fiance over here from India for about a year. She went there and married him, thinking it would be easier to get him here if he was her spouse. It's been two years and he still hasn't been able to move here.

She was detained for at least two days and it sounds like her H could not get any information regarding the situation. FTA:

Garcia, 22, had been waiting helplessly in Vilseck, Germany, where he is stationed with the 2nd Cavalry Regiment and awaiting imminent deployment, for word of his wife since Tuesday afternoon.

Araceli Mercado Sanchez, 22, who has been in the U.S. illegally since she was a young child, was released on Thursday from an immigration jail in Eloy, Ariz.

Detained for a bit longer is downplaying the detained for two days without releasing information to your husband regarding your status as they work to deport you.

Yes, we give preferential treatment to people who are married to citizens, gainfully employed by our military, with imminent deployment to a combat zone pending, with very young children, who are in the process of becoming a legal citizen, with proper identification.

A Military Spouse ID Card, whether or not she had it on her, is no more difficult than a drivers license to verify.

People around here in NJ intentionally drive *without* a license on them in order to drive at ridiculously high speeds but jack the ticket down to failed to present appropriate documents.

The suggestion that you drive around with your long form birth certificate is absurd. This is not soviet farking russia circa 1960.

Yes. She was brought here illegally at the age of 4. The naturalization process takes years and begins at the age of 18. To become a legal permanent resident she needs to live here for 5 years or more, or be married to a U.S. citizen for 3 or more years. They've been married 4 years and she's 22 years old, and the process of becoming a legal permanent resident and then naturalizing as a citizen is not simply a matter of taking a test and waving a little flag.

So again, yeah. She shouldn't have been driving. Neither should that biatch from Teen Witch but she's white and rich.

Plus she had two years to sort all of this out and apparently chose not to.

skullkrusher: wedun: skullkrusher: wedun: DrewCurtisJr: Bathia_Mapes: She didn't and according to Arizona law, she can't get a driver's license until she's a citizen.

That's not true. Legal residents can get an AZ driver's license, you don't have to be a citizen, just here legally.

Sorta like how folks can eat cake once they run out of bread.

You must be a person who is not in violation of government residency laws to acquire a government issued license to operate a motor vehicle == Marie Antoinette.

You sir, are a genius.

I think it captures the complete lack of empathy pretty well.

empathy that people in the country illegally cannot obtain government documents is akin to being blind to the struggles of people starving to death? I think your Empathizer2000 is set a bit too high.

You're right, I'm a bit too sensitive about this and should just accept that undocumented immigrants are treated like the subhuman underclass in this country. Maybe I should be more interested in a more pressing issue, like abortion, gun rights, voter fraud, tax cuts, or welfare entitlement reform.

lennavan: PsiChick: Also, as another Farker was kind enough to point out, this is a big deal because a young child was left with both her parents gone for no good reason.

Yes. One parent decided to join the Army knowing he would be shipped far away and the other parent decided to go out driving without a license. Farking police.

Because clearly trying to earn citizenship for your wife and not having public transportation to rely on to take care of your child is a crime. Did you even read the article? This wasn't the police policy at all. This was the result of a culture that is ridiculously racist. It could have, and should have, been prevented.

I dunno qorkfiend, I'm gonna side with wedun on this one. I'm kinda pissed off the hospital won't let me perform surgery. What like I need some stupid farking piece of paper that says I went to Medical School? Dude, I've got youtube and shiat. I just want to live a middle class lifestyle without the meaningless credentials.

meat0918: Esc7: Masso: I alone am best: People complaining about this are morons. She married a US citizen. She could have had this taken care of already and then she wouldn't need to worry about it. Instead she decided to ignore her legal issues and continue on, then when she gets pulled over for breaking numerous laws its all "OMG!! NAZIS@@@!!!!".

They are working on her immigration status according to the article. Part of the reason the hubby went into military.

I'm not too smart about immigration procedures. So when you marry a U.S. citizen, you don't automatically become a citizen?

9/11 changed everything.

Even before 9/11 you didn't automatically become a U.S. citizen when you marry one. It does make it easier to get residency. Didn't any of you watch Green Card?

I'm gonna go fly me some aeroplanes. I've always wanted to try my hand at a 787. It can't be that hard.

StaleCoffee: Detained for a bit longer is downplaying the detained for two days without releasing information to your husband regarding your status as they work to deport you.

And they verified it and released her. What's the beef? The system worked. Oh, it didn't work fast enough? Gee, maybe she shouldn't have been driving around without a license? Maybe she should have entered the country legally? I dunno, I'm just spitballin here.

StaleCoffee: The suggestion that you drive around with your long form birth certificate is absurd. This is not soviet farking russia circa 1960.

While I appreciate the comical value of your ridiculous hyperbole, she was an illegal immigrant. Driving around with the long form birth certificate would not have helped her. You're acting like she's a legal citizen. She's not.

StaleCoffee: So again, yeah. She shouldn't have been driving.

An illegal immigrant, driving around without a license, spent two days in jail. Are you sure you really want to argue this one out?

guess what else. She doesn't have a SSN. Know what that means? That DMV that issues those licenses ain't be subsidized by her.

You need to be certified to fly a plane, but you can only get an airplane certification if you are the living descendent of a former pilot. Otherwise they will find you, and they will lock you up and take your plane away.

Magorn: Somebody who supports AZ's state bill 1070 step up to the plate an answer a question for me:

The authorities discover that someone is here "illegally". Further investigation reveals that they are gainfully employed, productive, tax-paying citizens with no criminal record.

Can't pay taxes without a valid Tax ID. Can't legally work for pay without one, and if you have a EIN Tax ID, that number won't suffice for the I-9 form for an employer. So if they are paying taxes, they are probably committing identity theft by claiming someone else's SSN.

I RTA to indicate that their attorney hadn't yet filed the paperwork for citizenship; they were still filling out the forms.

After 4 years?

The wife has a path to citizenship in this case. If her paperwork was in the system, I think the attorney would have mentioned that - because that puts everything back on the Feds - they are delaying this, not us.

//ok with legal immigration
///this is a mute issue for the time being, Mexico has a booming economy compared to the U.S.

Alternatively, you could go through the standard process of being classified as a pilot, so you can get your certification and fly a plane.

The 14th Amendment lets anyone born in a plane become a pilot.

Either you're trolling or just a complete ass to think that 2 days silent detention is okay for a traffic violation. She was 4 years old, and as I explained, legal residency takes awhile. Or you could just be a sarcastic twat, completely ignorant of the process involved in becoming a citizen of the country you live in.

She had identification. It shouldn't have taken two days detention without bail. When they toss your stupid ass in lockup because you forgot your wallet I'll try to shed a tear. Unless you're white, then no worries. Leave it at home and jack the ticket down so you can do 90 in a 55.

lennavan: While I appreciate the comical value of your ridiculous hyperbole, she was an illegal immigrant. Driving around with the long form birth certificate would not have helped her. You're acting like she's a legal citizen. She's not.

She's here legally. The long form birth certificate was part of a discussion earlier in this thread. Apparently you're incapable of researching anything more than five minutes old, I guess.

lennavan: An illegal immigrant, driving around without a license, spent two days in jail. Are you sure you really want to argue this one out?

No, not really. You're not interested anything but being a complete dick about it. I'm sure you'll either ignore the actual process of naturalization and the situation or come drag out some shiat about why it's okay to detain someone for 2 days because they're illegal, even though it's more or less next to impossible to prove anyone is illegal unless they're going through the legal process to become a legal citizen.

Clearly, yes\no questions and black-and-white thinking makes complete and total sense when the woman was going out of her way to not commit a crime and had circumstances conspiring against her.

Okay let's do some choose your own adventure style roleplaying.

You are an undocumented immigrant and the mother of a baby girl.

Do you:

a. Wait indefinately for the right to live a normal life?
b. Risk offending the reactionary, anti-immigrant elements of this country?
