CSB: I'm also about 1/32 Native, at least from my mom's side. Don't know much about my dad's side but there is some there too. I look white as a Nazi (close German ancestory might have a bit to do with that), so don't judge a book by it's cover.

I'm sorry you were both too dense to understand the post as I originally wrote it. I'll try here one more time, though I suspect I'll again fail to explain this is a sufficiently clear way.

Affirmative Action programs in higher education exist to benefit minorities that have historically been discriminated against. As a matter of fact, the only reason the Supreme Court upheld AA programs in state run law schools was that they serve to remedy past institutionalized discrimination (see Grutter v. Bollinger, 539 U.S. 306 (2003)) . Elizabeth Warren, as a law professor, is well aware of who AA programs are intended to benefit. She knows that people are 1/32nd native *aren't* the intended target. Therefore, she knows that *she* is not someone that AA programs are intended to benefit. Yet she saw fit to list herself as a minority candidate on her hiring profile with the AALS, and allowed her employer to claim her as a minority for AA purposes. Her employers clearly benefited from this misclassification. And yes, it is clearly a misclassification, not because she isn't actually 1/32 native, but because it is clear that people who are 1/32 native are not the intended beneficiaries of AA.

I have more native american blood in me than she does, but if I claimed native american status on my law school application or my AALS application and benefited from that by receiving AA, that would be improper. That benefit is clearly intended to benefit people other than me. I would expect that I would face consequences from the state bar and from my current employer if it were discovered that I abused the AA system in that way. Warren also knows this, which is why she's been busy denying that she ever made the claim, and then denying that she ever received any benefit from it, rather than just admitting that she took advantage of the system.

Naah. She didn't even know she was 1/32nd until she got called on it, then had to conduct a search for her "roots" that were apparently very difficult to trace. The real problem is that even her claim to 1/32 Cherokee is dubious as it's not supported in any original documents. The fact that her claims are so tenuous should be the first indication that she misused and abused the program.
