I guess they could prosecute this as a violation of civil rights, but that would be very, very difficult, and I'm not even sure the laws would apply towards this.

Missoula Police Chief Mark Muir acknowledged his department had received roughly 80 rape reports in the past three years, a figure he said he had recently researched. But he said that, after investigating both his department's statistics and statistics of departments in similar sized towns on a per-capita basis, that figure was at or below the average level of reported rapes for U.S. college towns of similar size and makeup.

Muir, who said his department would cooperate with the inquiry, said he did not know how many of those reports had resulted in criminal charges being filed because he had not had time to do any research.

I just skimmed the opinion, and I don't see the Justices saying what you say they do. Do you have some more detail? Because the opinion is actually talking about Federal laws throughout as far as I can tell and whether Congress intended the law to be applied in the fashion the 3rd District tried to.

The only mention I see of state vs federal law is about the extent of the penalty that Feds can impose for a state not complying with Federal law and whether or not that penalty must be limited to the Feds cutting off funding, or if other actions or fines can be imposed.

I also think that in the case of unequal enforcement of criminal statutes, you are going to run into all kinds of due process, 14th amendment, and maybe even Article 4 problems that the Federal government is bound to enforce.

80 reports of rape at University of Montana which is known as a party school with a decent football team. Their past time is drinking until they black out. Both the girls and the guys. Right off the bat there are quite a few regret/save-face rape charges.

Now the problem with the OTHER ones is the football team that are treated like gods because they won a few championships. They are desperately clawing their way back to their former glory, so they will not do anything to jeopardize their chances, even if it means covering up a few legitimate rapes so their players can keep playing. It is really despicable.

To attribute this problem as something state-wide is farked up though. U of M has always been off in their own little world and since people around here get a hard-on whenever the Griz is mentioned they will continue to hold themselves above the law.

Welcome to the seedy underbelly of college sports; at least 3 or 4 times a year, I hear a similar story. Girl meets athlete; girl and athlete get drunk; girl goes home with athlete; next morning she contacts police to report a rape. The university leans heavily on the police department and the DA to bury the case; the university uses its discretionary fund to pay for the girl's tuition, the girl signs a nondisclosure and the whole thing gets swept under the rug.

So yeah, the reported rate in Missoula is just about the national average.

And since no one bothered to RTFA, I'll just point out, again, that both the football coach and the athletic director at UM were fired recently over this. Not put on paid leave, not given a time-out, not sent a strongly-worded letter--they were called into an office one morning and fired.
