ongbok: Brainsick: ongbok: what ever the kid took while he was in the cell I believe he brought in himself and didn't find in the cell

A. If the cops didn't find something on him, he probably took it to get rid of evidence
B. If he did actually find it on the floor, he broke rule #3 of the holding cell "Don't eat drugs off the floor"

/add me to the chorus hoping this guy gets a payday, this is an inexcusable oversight for a detention facility

Oh yeah he will get a payday for being left in the cell, and he deserves it. I'm just calling bullshiat on the whole they left meth in the cell thing. And for the record since he wasn't under arrest or being booked he wasn't stripped searched or cavity searched so there were many places that he could stashed some meth on himself that would have been missed in a pat down.

If he was a meth user, don't you think he would've snorted it? The idea is to get it into your blood system as quickly as possible, and meth is absorbed quicker through the mucous membrane quicker than through the stomach lining. But there's this niggling fact that if they could forget about a person who hasn't even been charged with a crime for five days while he's kicking and screaming, it doesn't surprise me that they don't routinely clean the cells.

And the meth, or even the pot isn't the point. The point is that this man was held, without being charged with a crime for five days. He wasn't given any water, any food, no phone call, he was thrown in a cell for five days. And he was never charged with a crime. The DEA admits that. Even if the guy was a meth dealer, or a meth addict, or a pothead, his civil right to due process was violated, and the authorities involved just said "our bad". I don't care what a person has done, if they're taken into custody they either need to be charged, or released.

You are standing in a holding cell. There is a door to the south.

>look north
There is a wall.

>look down
You see the floor, there is a powdery substance.

>take powder
It's very powdery.

>eat powder
...

Mock26: RandomRandom: Mock26: I cry bull dung! I think that the kid is lying through his teeth and probably chewed on the glass so he could try and make some money. Is it possible he was forgotten, yeah. But I think it highly unlikely.

So he faked the failing kidneys?

And then the DEA paid for his hospital visit out of the kindness of their hearts?

Really? Some folks cannot believe that law enforcement could possibly be this incompetent. Well yes, they can.

/interestingly, often the same folks who believe the very worst of "government" give law enforcement a complete pass.

Failing kidneys. The kid could very well have been too stoned to take in water. He could have refused to drink water. He could very well have had a kidney problem before he went in.

Who is giving them a "complete pass"? Certainly not me. I just said that I think the kid is lying. That is certainly nowhere near to being giving them a "complete pass."

As for them being incompetent, care to quote me where I said that it was not possible for them to be incompetent? Funny thing that is that you cannot, because I never did say such a thing. I merely said it unlikely. And last time I checked "unlikely" != "not possible."

Only thing I would add. If his kidneys were failing they damn near killed him. I hope there was no permanent damage. If he was in ICU for 3 days I'll bet he didn't have more than a few hours left.

Rincewind53: omeganuepsilon: m3h: Holy FARK, that is crazy. I would be curious to find out what actually happened between "he was offered a ride home" and "he was placed in a cell for 5 days"

I forgot to mention, that was my first thought too. Much more to this story. Maybe we're just hearing the stoner version first?
Maybe he was a dealer or something serious, so instead of a ticket/warning, he got arrested, then forgot about, then charges dropped/hidden when he got found, a sort of "we're cool right?"

Reading a couple of other articles on this, it seems likely the chain of events went as follows:

1. College kid arrested at house
2. College kid taken to station, interrogated, and then brought back to holding cell
3. Police (a) decide to release him, (b) issue release order, and (c) complete whatever procedure necessary to indicate that someone's been released.
4. Somewhere between (b) and (c), where normally someone would then go down to the holding cell to retrieve him and release him, that never happens. But because (c) occurred, the system thinks he's been released and the cell is empty.
5. Five days of urine drinking

You make it sound so easy. Was hoping for something juicy here, but that makes too damn much sense.
Still a holding cell that's not checked on is farked up in and of itself.

He was in a holding cell. People are generally only put in them for a short period of time in situations like awaiting to be bailed out, booked into the jail & waiting to be taken to the regular jail cells, etc. Since they're used temporarily they usually don't have toilets or any sort of water supply.

Holy shiat this is scary. He was probably put in there until the agent could finish something up and then drive the kid home, but somehow after smoking all that confiscated M.J. the agent accidentally the kid.

I really hope this kid gets a lot of compensation, but I also hope none of his injuries (physical and mental) are permanent.

who didn't get counsel

many are foreign born aliens

on visas

where were the other occupants at the 420 house in University City locked up?

Also want to throw out a big ol' fark you to the trolls in this thread. Kimothy: If this is true, the DEA farked up completely. I imagine any jury will be fairly generous to the guy - especially since his kidneys nearly failed.

No jury will ever see this case. It'll get thrown out by a judge claiming that Section 1983 doesn't apply, an appeals court will side with him, but the Supreme Court will hear the case and redefine 1983 to only apply to beatings and killings. This man will be out of luck, and millions of people will be stripped of yet another right in the long list of recent losses.

I find it plausible that some previous occupant ditched the meth there, probably under the assumption that he or she would be stripsearched properly when transfered to jail.

It probably wasn't on day one that he decided that eating powder from the floor was a good idea I'd imagine, probably came after he started to loose his cognitive functions.

Great. I've never seen Anchorman, and this thread got me curious. So I just googled "San Deigo Whale's Vagina". Now I'm probably going to end up in a holding cell for five days, and drinking my own urine is going to be problematic because I'm a not very flexible female.

I had a week of sleep deprivation training, too, but I wouldn't want to be in his position. I can deal without food, but I wouldn't want to be in his situation. POWs are given enough food and water to survive - generally - while this man had NOTHING for 5 days. You cannot survive without water.

Spencer, MA cops arrested my friend in his backyard for no reason, smashed his hand in the cell door then left him there for about an hour while his ruined hand squirted blood all over the cell. They then mysteriously lost the camera footage of his cell and a judge dismissed things in a way that blocked his ability to sue. They were chasing someone else and ended up tackling my friend in his backyard thinking he was the guy they were chasing. He didn't know what was happening so he fought them and they arrested him for resisting arrest. They never said what they were arresting him for for him to be resisting.

Wow, you are truly something else.

Anything to avoid implicating law enforcement, right? Nevermind that they don't dispute what happened. You're now just making shiat up to clear law enforcement of wrongdoing.
