Somebody needs to make an "Is it assault?" flow chart working with variables of gender, race, relationship, cohabitation, geographic region.... etc...

Or maybe somebody already did. I'm too lazy to do it... or look.

But the one in my head is pretty funny... and I only care about my own happiness... so entertain yourselves... I'm not your farking clown.

I'm honestly trying to figure out where you're coming from.

Based ONLY on the linked article, what parts of that linked article suggests to you the man committed assault on the woman?

What is your basis for calling his behavior an assault, and not self-defense? And do you say the same abysmal expertise I have, that is, just schmoe in a forum, or are you actually a lawyer versed in this, or ...?

What is the range of actions you believe a person being assaulted can do during the assault to escape the assault and yet, not be charged with assault?

P.S. Since this is Florida, is he covered by Stand Your Ground?

The fact that he admitted pushing her out of the way which resulted in damage to the drywall. Contrary to your earlier assertion, in poorly constructed homes it can be quite easy to dent. I don't make the same assumption you do that it was a towel rack.

It gets tricky with domestic violence, I don't believe the standards permissible force are the same as a home invasion or random assault.


P.S. Since this is Florida, is he covered by Stand Your Ground?


Again, not sure if that applies in domestic assault cases.

Happened to one of my friends. He was sitting on his couch watching TV ignoring his girlfriend while she was yelling at him, so she hauled off and punched him in the head and broke her hand on his forehead. Despite him having a lump on his forehead and her having no marks or injuries beside her broken hand, he was arrested and charged and nothing happened to her.

absolutely retarded. its time to change this stupid law. we really need to let VAWA lapse or be amended to give equal rights and protections to everyone. women should be held responsible for their actions and good men should not go to prison. The 14th amendment seems to be lost.

It has nothing to do with the VAWA. Prosecutors in certain areas know that they can easily get a conviction against a man in a domestic violence case and use that to their advantage when charging and negotiating pleas. On the other hand they know it is very hard to get a conviction against a woman for a violent crime against a man or a violent crime period, so they don't even try a lot of the time. Don't blame VAWA, blame societal ideas about men being violent and women being delicate flowers.
