"The mark consists of, compromises or includes immoral, deceptive or scandalous matter."

"The state looks at things from a very narrow scope. I think they'll realize it's not our intention to be scandalous or deceptive," said Ardaji.

So, their intention is to be merely immoral then...

"immoral and deceptive" from the US state department?

Kettle, pot. Pot, kettle.

So my feline themed health drink store, Pussy Juice, would probably not go over too well.

"We were walking down the street and I said fuku he looked at me strange but he got where I was going," said Ardaji.

That is because you are saying it wrong.

This is dumb, puritanical and ethnocentric.

Fuku really means good fortune, wealth and prosperity.

I've been told that hundreds of times. I feel so much better now.

Just to be clear this was a department of a state government, not the State Department.

My wife and I opened a diner in the late eighties. I had high hopes, but after eight months, my bank account was wiped clean and my credit was maxed out. Whatever you do, do not go into the restaurant business. We worked fifteen hour days, prepared the best possible food, and gave it everything we had. I'm still paying off debts from that disaster. Can't figure out what went wrong.

Yeah, I've heard the restaurant business is brutal as hell - that you can have good food, steady customers, and still bomb. Sorry to hear you and your wife went through that. I hope your endeavors since have given you a better return.

In a letter to the owners' attorney, the Florida Department of State Divisions of Corporations denied the trademark request because, "The mark consists of, compromises or includes immoral, deceptive or scandalous matter."

Wait, this is the immoral, deceptive, and scandalous Florida state Government saying this?

2012-04-27 09:51:56 AM
IP lawyer pet peeve - not "state department" (which generally means the US Department of State). It's the state trademark office in Fark's favorite state (which is an office within Florida's secretary of state's office).

Unlike copyrights or patents, states have the authority to issue trademarks. Due to the Commerce Clause, the Federal Government has ability to do so as well (and does via the Lanham Act).

That is just FUKU-ing retarded on an epic scale.

It's not like Japanese is a rare or endangered language that nobody's ever heard of. Fuku (pronounced "foo-koo") is actually one of the more common words you'll see in family names, place names, business names, etc. because it means "luck". Hell, the kanji is right there on the sign!

What's next, is Florida going to refuse to allow Hispanic parents to name their kids Jesus because it's an insult to Christianity? Are local newspapers going to be fined if they don't refer to the nuclear disaster in Japan as the "F***shima nuclear power plant meltdown"? Will libraries have to change their English Literature section to include books by Charles D***ens?

The restaurant didn't say anything objectionable, but I will - FU Florida.

You can hang up one of these signs and call it Fugu

www.nomadicphotos.com

The FDA prevented fugu fish from being sold in the U.S. for human consumption but I think that has changed and I'm too lazy to search. You can still sell shellfish in months with no "Rs" but I doubt people would eat them.

I see no problems with it... since I read it as 'foo coo'.

You pronounce it right, so good job! Can also mean "happiness," which is how it was always explained to me. Fukushima (happiness island), Fukuoka (happiness hill), etc.

That actually is the correct pronunciation. In fact, that's the way you're supposed to pronounce almost any Japanese syllable with a U in it -- consonant plus short "oo," like with ru [pronounced like the English word 'rue' except that the length of the vowel sound is shorter], mu [moo], su [sue], tu/tsu [both are the same, usually pronounced with a T sound right before 'sue' with no gap in between], etc.

There are a few exceptions -- if it's after an O then it's pronounced kinda like both Os in 'Tokyo' (which could technically be written as 'Toukyou,' 'Tohkyoh' or 'Eastern Capitol,' but those are almost never used)

They changed the name when they moved the capitol from Kyoto ('Capitol City') to the east. Hence, Tokyo ('Eastern Capitol')
