You can't make a law unconstitutional just because you want it to be.


Immigration is clearly defined as being under the powers of the federal government. States have no business getting into it. There are a limited number of powers that the constitution grants to the federal governments but things involving other nations including immigration is one of them. States are only allowed powers NOT granted to the federal government.

The cost of drywall installation in the Phoenix area went down for years. The reason why was those crews of 4 or 5 guys were put out of business by contractors who would low bid and pay illegals to work illegally for them.

So where is the probable cause to jail a citizen that hasn't commited a crime?

I would be shocked if they were capable of affording more private living quarters, it's expensive to live here & they work for pennies. i wonder if an American owns the land and structure that provides them with shelter & who writes the check to cover rent?

The thing that confuses me about state powers and federal powers is that one cannot serve two masters.

Let's say you're an officer of the law and you have to enforce the law to the best of your ability. You see a person smoking pot, and you know that in your own state, smoking marijuana is legal for medical purposed but federally, it is considered illegal, especially possession.

Now, the best answer offered so far in my searches is that federal law trumps state law. This makes sense when it comes to interstate commerce or for any crime that involves more than 1 state.

What if it is entirely in one state? The growing of the contraband, the harvest, the sales and the use of it, all of it in one state?

how does that make sense?

My wife is a legal immigrant. We hired an immigration lawyer and went through an official interview process. My lawyer joked that if she was from Mexico none of this would be a problem.

Why can't we just have fair practices for everyone? Why do some people get cutsies?

partly because i am sympathetic to the living condition they face at home & im an American I want others to experience the same standard of living that i do. I don't hold the people of Mexico accountable for the greedy business practices of their government. AND i may think that America is somewhat responsible for the conditions from which they suffer from in their own country.

and their legal status as immigrants doesn't reflect (at least not to me) that they are sub humans that need to be extinguished. they are HUMANS trying to make a living on the rock we share.

It has been interpreted that even if it all happens in one state you are still taking a customer away from a dealer in another state. It is too much work to amend the constitution to remove the 10th amendment, so they just did it this way instead. The Commerce Clause should really be renamed since it is so confusing. I know I'm late to this, but I'd just like to add, that the Mexicans (really, what other Latinos are there in Arizona? Ok, maybe some Guatemalans) darn near admit their guilt by being all up in arms about this while all the Asians, Europeans, and Africans don't say squat.
