I've heard that there is some controversy within the DOJ about taking this on, so the compromise was that they'd do it but they don't want to rock the boat too much in an election year.

That's just what I heard from an immigration attorney who was involved when it was in the 9th circuit.


Half-assing it in the appellate courts is seldom a good strategy. If that's true, anyway.

I think their argument is that states can't do it on their own, but they can if the Feds give them the authority. Not entirely sure about that though.


I also have trouble reconciling the federal government's requirement that employers check immigration status when hiring employees, with the Justice Department's insistence that state/local law enforcement agencies *not* check immigration status of suspects. Criminal suspects must not be checked, but job applicants must be checked.

Perhaps that would be cleared up if I read the briefs, but it doesn't matter enough to me to do so.

Along those lines.. Something similar has been brought up here in CT as part of the debate over medical MJ. Some of the legislators opposed to it are worried that the Feds will come in and screw with the state, or that it will look like an attempt to nullify a Federal law.

I think that might be because hiring an illegal immigrant is a crime in itself, especially if they're using fake Federal documentation like an SS card. But someone's immigration status doesn't really matter if they were doing 100 in a 55, because them being here illegally doesn't change the initial crime I think.

Not sure about that either.

The federal government refused to enforce immigration laws for years.

Illegals won't do the right thing and leave.

This came up huge in the whole discussion of "voter-ID" laws, in which poor and elderly people were being denied the right to vote because they didn't have photo-ID's and were unable to get them. So with that background how the hell did he allow Arizona to claim seriously that they could 100% determine legal vs. illegal immigration status for ANYONE in only about an hour?


I always thought that it was odd for the Liberal stance on the "there are so many people who can't get IDs" issue wasn't to come up with a way for them to legitimately get IDs (you know, so they can hold a job, drive, fly on a plane, cash a check, get medical insurance, obtain government benefits, open a bank account, see an R rated movie, etc.).

That makes me wonder. What about the sub-minimum wage work that prisoners have to do in prison and many jails? Would the sheriff or DOC be required in his capacity as an employer to check the immigration status of the inmate-worker, or be prohibited in his capacity as a jailer & law enforcement officer from checking the immigration status of the inmate-worker?

Aarontology: Citizens shouldn't be detained until they prove they're innocent of a crime that may or may not have been committed. And before everyone freaks out, if they could tell who is a citizen and who isn't this law wouldn't' be necessary in the first place.

I think that's already well established in law, which is why you cannot be detained beyond "a reasonable time" or arrested except upon probably cause of a crime. That's why whenever a cop talks to you, your name is "Am I being detained?" and your occupation is "Am I free to go?"

Once you are detained, however, you can completely clam up and elect to say no more without the advice of a lawyer, and incidentally you do no consent to a search, but one thing the cops can compel you to do is identify yourself. If you don't have ID, you can provide your name and home address, and the cops can continue to hold you until they've verified that name relates to you. That process of verifying your identify can include verifying your immigration status or citizenship, checking for warrants, etc. The fed gov is obligated by law to provide an answer to state and local authorities if they are asked for immigration status. "Reasonable time" requirements would be binding on the fed gov as well in this case: to make that standard, anyone that the state and local authorities may enquire of must respond within a time period to meet that standard.

If you have no ID and your name you gave doesn't add up, the cops can continue to hold you until they can identify you. "Reasonable time" is very subjective, and it may be extended if the name you give doesn't add up. If you say you're Eitan Schultzenstein, and the record they find for that name matches a 67 year old Rabbi in Manhattan, and you don't speak any Hebrew, but you speak with a French-Canadian accent and look 23, it would be reasonable to ask more questions along the lines of identity.
