However, during oral arguments Wednesday, the court's liberal justices and some of its conservatives expressed concern that holding people who have been arrested until a check of their immigration status is complete could violate their rights by prolonging their detention.

Which is the only part of the law I have a problem with.

Citizens shouldn't be detained until they prove they're innocent of a crime that may or may not have been committed. And before everyone freaks out, if they could tell who is a citizen and who isn't this law wouldn't' be necessary in the first place.

I've heard that there is some controversy within the DOJ about taking this on, so the compromise was that they'd do it but they don't want to rock the boat too much in an election year.

That's just what I heard from an immigration attorney who was involved when it was in the 9th circuit.

I think the feds kind of sabotaged their own claim to exclusive powers over immigration enforcement when they got Homeland Security all involved with the states regarding immigration status checks. As I understand it, under certain circumstances DHS is requesting states pass on information about immigration status when it is pertinent to their work. Now DOJ is claiming the states have no right to do immigration checks. Er, can't have it both ways.

I think their argument is that states can't do it on their own, but they can if the Feds give them the authority. Not entirely sure about that though.

This made it all the way to the Supreme Court in nanoseconds. I didn't see them freaking out over sanctuary cities, which also oversteps federal law.

Despite her other concerns about the Arizona law, Sotomayor quickly chimed in to say she, too, was baffled.

"I'm terribly confused by your answer. OK? And I don't know that you're focusing in on what my colleagues are trying to get to," she said.

Chiming in, Thomas stated, "..."

Verrilli then said the mandatory-check provision could lead to "harassment" of people because of their background.

"We are not making an allegation of racial profiling," Verrilli said, adding a short time later, "You have a population in Arizona of 2 million Latinos, of whom 400,000 at most are there unlawfully."

"Sounds like racial profiling to me," Scalia quickly interjected, taking Verrilli to task for making an argument he'd sworn off earlier.

"Are you objecting to harassing the people who have no business being here?" Scalia asked skeptically.

Thomas appeared to agree, noting, "..."

When Verrilli later tried to explain why systematic checking was objectionable, but "ad hoc" checks were not, Sotomayor again stepped in.

"You can see it's not selling very well. Why don't you try to come up with something else?" she said.

You do realise that the court wouldn't have to decide if Congress did its job and passed appropriate federal legislation?

Don't criticise the Supreme Court for having to step in to do something it was never meant to do...

So the Solicitor General of the U.S. allowed himself to be boxed into saying an "imigration status check" only takes an hour or so?

Holy jumping catfish - doesn't that dipshiat have any idea that there are thousands (possibly hundreds of thousands or more) of people who were born in the U.S. but who don't even have a birth certificate? People who don't really exist in any federal database but who nonetheless are citizens?

This came up huge in the whole discussion of "voter-ID" laws, in which poor and elderly people were being denied the right to vote because they didn't have photo-ID's and were unable to get them. So with that background how the hell did he allow Arizona to claim seriously that they could 100% determine legal vs. illegal immigration status for ANYONE in only about an hour?

I ain't mad at the headline but people do make me laugh- "if the judges don't agree with the argument it's the lawyer's fault. Somehow."

Why do people think this way? Especially in these constitutional cases, which are political in nature- ie, "how far can states go in dealing with possible illegal immigrants? How far can Congress go in regulating markets?"

Put it this way- if there is a justice whose answer to cases like these depends on a smooth oral argument from a lawyer, he/she does not deserve their job.

You know, the feds are funny that way - that is, in wanting it both ways. For example, a referendum passed in Denver requiring DPS to assign pot offences lowest priority, but DPS basically is refusing to follow the will of the (overwhelming) majority of Denverites because they say federal law is supreme. So, DPS will not do immigration checks on behalf of the feds, but will most certainly bust pot smokers at the behest of the feds. It's like these various jusrisdictions and agencies and departments at all levels are just kind of making it up as they go along. The rule of law is breaking down into simple expediency. That's a bad sign when your country starts sleazing things like that, refusing to enforce its own laws, and taking diametrically-opposed positions from one day to the next and pretending it's all based on "principle."
