Not sure why there charging him for this. The state is supposed to provide the bare necessities, such as the right to bare arms. But libs have been eroding these rights for years, hence the reason ZimmerMAN is in jail to begin with. Going to jail for defending yourself...this is life under the seedy rule of Barack "Hakuna" Omatada. America is like a whole new world with this guy in charge, and I do NOT want to be part of that world. The "stand your ground" clause of the constution says you should be able to shoot people who scare you, no strings attached, and thats why there are no strings on me and I will continue to honor the Founders by shooting high homeboys like they intended (I am NOT racist, by homeboys I meant people of all colors of the wind [I dont even see people in terms of color)]) and if you got a problem with that and want to start something with me, be my guest and be a man. Because I am armed, I AM a MAN, and Ill make a man out of you too by shooting you. The cops wont know who did it at first but then someday my prints will come back to haunt me and theyll match my ballistics, but they still cant charge me because I stood my ground and the Contstution supercedes the states. And then I will kill more and more people until everyone is dead and THEN I will be safe. Its called the circle of life, deal with it libs.

arethusa: TheShavingofOccam123: The reason why they went to second degree and not first is because they figured a grand jury would never indict on first degree murder. By going second degree, they guaranteed they could charge and pretty much guarantee no conviction.

I'm assuming Florida allows pleading down to a lesser charge so he could plead guilty to a lesser charge and do some time. Certainly not the minimum 19 years to life for second degree.

That's my understanding according to those who know what they are talking about.

Charge him higher and let it plead down. I really only posted that so that six pack and a half could get a his racist a** in an uprorar.

But I wouldn't want to be the prosecutor that lets him plea down to probation. I would bet the prosecutors would be happier with a quick trial and no conviction.

Trayvon's mother said she figures it might have been an accident so I think some people would be comfortable with probation or a few years.

arethusa: While this is not breaking news, the link with the investigator's affidavit sure was. I read it and left and now it is not there.

To paraphrase - Profiled and hunted him down, enough to get him for 1st degree, but they aren't going to let anymore information get out to the public.

RTFA. He's being charged with second-degree murder, not first.

I KNOW what he is being charged with; I am repeating what the investigator's report said. They said they had enough for FIRST.

I guess you can read it for yourself when it pops back up.

I'm guessing that they feel there's a better chance of getting a conviction with a second degree murder charge. Even then, the maximum sentence for that is life in prison.

From what we know so far, which really isn't much, they barely have enough to make 2nd degree murder stick. Despite her claims to the contrary, the prosecutor bowed to public pressure. At some point they may offer a plea deal for manslaughter, but I doubt it. The pressure to get a conviction and avoid a riot will be too much. There will be a trial with Zimmerman walking in the end. Then we'll have the riots.

SkinnyHead: Bathia_Mapes: SkinnyHead: Why are they charging him for these necessities? Isn't the state responsible for providing him with the necessities of life?

It's that way in nearly every jail. He gets the necessities, but like any other inmate, if he wants snacks, certain items of clothing, distractions such as puzzle books, playing cards, etc. that is paid for by the inmate. The latter do not qualify as "necessities of life".

Oh, and you're a f*cking troll too.

He's not in jail to be punished. The state owes him more than just bread and water. If they're going to hold him without bail, they should at least provide him with common comforts.

like a flat screen tv and a kindle.
maybe they just owe him what everyone else in jail gets

Where I worked, they were entitled to having basic hygiene necessities made available to them. They had to purchase them with their own money unless they were completely broke (in which case they were given a 'hygiene kit'.. I forget how often).

When I worked for the custody referee (jail referee) at the Lane County Jail back in the mid-70s, they didn't have much in the way of a commisary, but all inmates were given a bar of Coleo soap, a pair of baggy green pants with a drawstring waistband, a matching green shirt with "Lane County Jail" in black across the back and some foam shoes that looked like the kind you might see in a hospital and a small comb. Inmates could buy stuff like shaving cream & disposable razors, but couldn't keep them in the jail area. Their name was put on them and when they wanted to shave, they had to be supervised by one of the jail employees. Unless they were going to court, female inmates weren't allowed to wear bras, but underwear was okay.

All newly booked inmates had to undergo a body cavity search (male COs for male inmates, female COs for female inmates), then a shower and shampoo using a lindane based product (usually Kwell). The body cavity search was also performed before they were taken for a court appearance and again when they returned to the jail.

How far up a person's ass do they actually probe during a body cavity search?

If an inmate shiats on their hand before the guard penetrates, do they still penetrate the inmate's bunghole?

I don't know about the males, but with the females it was "bend & spread 'em". The female CO would look up their rectum and vagina for any contraband (usually drugs) using a high-powered flashlight to illuminate the area. I know this because I got roped into being an observer during the body cavity searches when there was only one CO on duty and no female deputy handy. The jail required that all body cavity searches involved two people. The one doing the search and an observer.

The worst thing I observed were inmates deliberately farting in the CO's face and then laughing about it.

Lead prosecutor Bernie de la Rionda would not discuss what other evidence prosecutors have against the neighborhood watch volunteer, except to say it is enough to support the first-degree felony charge.

IANAL, but that wording may be saying something different than you think. Perhaps second-degree murder is still classed as a first-degree felony.

9beers: The affidavit reads like it was written by somebody who browsed a few of the Fark threads on the subject. A first year law student could win this case. Given the fact that Zimmerman's attorney has 30 years of criminal defense experience, he'll rip this to shreds so badly that the prosecutor will resign before she has a chance to be fired again.

Was she already fired? Unless they have other evidence, they need to find a whipping boy to take this case. Someone who doesn't mind pushing papers or moving to another state to practice.

Seems like they have other evidence or they would've gone with manslaughter.

Having enough to file an Information is one thing, enough to secure a conviction is something else. There is still a slight possibility that a judge can throw the case out based on the stand your ground defense Zimmerman will raise. However, I don't think any judge will risk his house, or his life. Nope, the media circus is just beginning.
