Teachers are considered ministers in that school and SCOTUS already ruled that the Government cannot appoint religious leaders for said religion

My cousin is a Spanish teacher at the local Catholic high school. She has kept up her home residence solely to keep her job, as she's been living with her fiancee most of the time. Schools can and do hold their employees to moral codes, and there's little to no way this would ever win in court, ESPECIALLY since it happened in Texas.

As much as we may personally disagree, the bottom line is that she signed a contract to be held to a certain moral code (Christianity). That she did not live up to the code is cause for her dismissal.

I attended a parochial high school. After I graduated, one of the teachers was involved in a scandal (he left his wife, filed for divorce, and moved in with a woman just out of college). The case lingered for a couple years until they settled out-of-court because it was heading for a stalemate. From what I understand, he won 2 years pay and legal fees (which wasn't much...about $100k and FAR less than the $250k he was seeking). The reason he was able to even get that much is that they couldn't prove that he was having an affair with this MUCH younger woman (he was 42 and she was 23) before he filed for divorce, nor could they prove he was intimate with her and violating a moral's clause after he moved in with her. Bottom line is that neither side felt like they had a sure winner.

A bit harder to fight if you're preggers.

Not exactly. SCOTUS said that just because a school considers someone a minister, doesn't mean they are. If that were the case, they could just say all their employees are ministers and be able to fire any of them for any cause.

In that particular case, the teacher took special minister courses, had a minister title, and led prayer services in the school district. According to SCOTUS, this made her a minister. In this case, it seems to just be a teacher who is allowed to talk about religion in class if she wants to. I don't think this will make her a minister in the eyes of the court.

That's not true anywhere. You can't fire people based on their race, gender, or because of a medical condition if it doesn't keep them from doing their job. I'd consider pregnancy a medical condition.

This is the scenario that fundies LOVE. It allows them to wallow in an ocean of moral superiority, since it's a vast smorgasbord of sex, sin, regulations, and religion. One of the main reasons that they hate contraception is because it significantly reduces this type of situation.

Done in one. If you cannot abide by the onerous medieval moral restrictions imposed on "ministers," either actual or paper, by a religious organization, don't work for that religious organization. If you violate that moral code, you can be fired with impunity.

Nothing says they have to apply that moral code equally, mind you - just ask any kiddy-diddling Catholic priest - so keep that in mind when interviewing at such places.
