I think the issue isn't his service. It's his oath.

AirForceVet: I think the issue isn't his service. It's his oath.

It's chain of command. Obama is commander in chief. Let's see this idiot go around bashing his company CO and see how that works out.

2012-04-05 08:51:46 AM
Uh... unless I'm mistaken, you're not supposed to follow unlawful orders from everybody, not just the President. Calling him out specifically implies he would follow unlawful orders from not-Obama which doesn't exactly help his case.

And while he says he's not conflating the military and politics, pretty sure the name Armed Forces Tea Party doesn't exactly create that perception.

2012-04-05 09:26:07 AM
I wish that ultra-conservative activist group, the ACLU, would mind their own business and stop trying to force their reactionary views down our throats!

2012-04-05 10:00:43 AM
Yeah, too bad. When you join the military you cease to be a normal citizen and become an integrated arm of the federal government, much like school children.

2012-04-05 10:00:46 AM
Getting fired for criticizing your boss on your facebook page is not a first amendment issue, and you're a moron if you think it is.

And yes, Obama is his boss. Chain of command, and all that.

2012-04-05 10:01:18 AM
You give up a lot of freedom when you join the military.

try starting a facebook page critical of your CO, your Battalion or Brigade commander and see what happens.

2012-04-05 10:01:39 AM
Yeah, let's encourage insubordination, that sounds like a good idea.

I'd rather see them encourage homosexuality, because what happens in the core stays in the corpse. Right?

The most reasonable course of action is to just enforce Facebook's policy that you must be over 13 to have an account (and have a 13 year old's ability to reason and follow a logical argument).

Tea Party problem solved.

2012-04-05 10:05:07 AM
federal congressmen

Must be a misspelling: should be feral congressmen, unless you live in a sovereign state.

2012-04-05 10:05:48 AM
Look, he's black, we get it. But you're a Marine, dipshiat. Don't do this sort of shiat. Do it in private if you want. Do it at the bar or on Thanksgiving. Don't air it in public like a Tea Party retard. It's his own damn fault for doing this while active.

And yes, I like that the ACLU is in on the case. But when you're in the frakking military, you play common sense and STFU in public.

2012-04-05 10:06:21 AM
I'm sure right-wingers would be fine with the government water-boarding this guy for more information about his insubordination, since it's not torture or anything.

2012-04-05 10:06:25 AM
FTA: "The military may be different from the civilian world, but it's not exempt from the First Amendment," said David Loy, legal director for the ACLU of San Diego and Imperial Counties.

So Marines can wear band T-shirts and boogie shorts to war? The core will be thrilled to hear it.

2012-04-05 10:06:54 AM
They are violating his constitutional right to be a soldier, right?

2012-04-05 10:07:13 AM
It would seem reasonable to refuse unlawful orders, whoever gives them, but that's not how it works in Obama's America. Colonel Terrence Lakin refused to obey lawful orders, and look what happened to him. Obama's supporters used Alinsky-ist tactics to destroy him and his career, and Obama's justice department sent him to jail.

2012-04-05 10:07:25 AM
As a veteran of the USN and a liberal I respectfully would like this gentleman to know that he should go and f*ck himself. You took an oath dumbass. That's how the military works.

\chain of command, duh?

Sounds good to me. Subordination is a bad thing.

I'm thinking this is all a publicity stunt so after he is discharged he can run for congress as the patriotic constitution loving American conservative who stood up to the chicago style thug in chief Barack Hussein Mao Stalin Pol Pot Soetoro Kony Castro Fartbongo and paid the ultimate price of not being able to sit behind a desk and recruit other people's kids to be sent to war.

So, a Marine states publicly that he will not follow orders from the Commander-in-Chief. Yeah, it's quite a stretch to say his court martial somehow denies his first-amendment rights.

2012-04-05 10:11:50 AM
The sad thing is this idiot will go back to his podunk redneck town and be hailed as a hero because he stood up to the usurper in chief, and will probably get elected to a local office and start a political career.

Jake Havechek: Yeah, let's encourage insubordination, that sounds like a good idea.

That happens on a daily basis. One of the OWS veterans that was pushed on the front pages was a member of a group that supported/taught insubordination and sabotage techniques.

Did that stop Farkers and others in the nation from treating the man like a hero? No.

But folks don't like actually researching the person they prop up on a pedestal....

fta: According to Pentagon directives, military personnel in uniform cannot sponsor a political club; participate in any TV or radio program or group discussion that advocates for or against a political party, candidate or cause; or speak at any event promoting a political movement. Commissioned officers also may not use contemptuous words against senior officials, including the defense secretary or the president.

Stupid marine is stupid.

Nice to see the ACLU take up his cause here but they are gonna lose.

Hmmmm.... I wonder if this could be used as a defence if there's ever a draft again. "The US government is forcibly seeking to limit my speech by lawfully compelling me to join the armed forces." If I were a judge, I'd buy that.

I'd be interested to see how you manage to define the Occupy rallies as a partisan cause without simultaneously destroying the claim that the Tea Party is cross-party.

Soldiers are in the Army -- Marines are not. Technically they are sailors as they belong to the Navy

Also Corps not core.

People in the Core are the best Soldiers. If didn't actually say that he would follow an illegal order from someopne else he has a legitimate case. Restating the UCMJ is most likely not illegal. But his career is toast and as someone stated he is planning on a congressional run most likely.

Lord_Baull: So, a Marine states publicly that he will not follow orders from the Commander-in-Chief. Yeah, it's quite a stretch to say his court martial somehow denies his first-amendment rights.

On the one hand, he's saying he won't follow them if he finds them unconstitutional. On the surface, that's a somewhat reasonable thing to say; if the President ordered him to rape a baby, the Marine would not be violating the law to refuse to follow that right. The problem lies in the incredibly stupid combination of the guy using his status in the armed forces to push a political agenda while acting as Area Man, Passionate Defender of What He Imagines the Constitution to Be.

2012-04-05 10:18:36 AM
Huh, NDAA? Yeah, lets use the military to detain citizens, without charge or evidence. If there is a charge, or evidence, its kept secret. Ever heard of Posse Comitatus?

Do you even think its legitimate to use the military for that purpose? I heard NAZI Germany did it, Communist Russia, and Communist China. So I applaud this guy for standing up and saying something.

Dear shiatbag: There's a difference between "former soliders supporting their country and fellow citizens" and "current soldiers committing treason". The fact that you can't see that tells me all I need to know about you.
