That's a good question. That would be like being acquitted of ever setting foot in a bank, but deadlocked on whether or not you robbed it. There has to be more to this somewhere.

Yeah but you would have to be SO openly racist. How else could you explain that to your fellow jurors other than to say "Look, he's black and we have an opportunity to convict him of something, I'm not going to pass that up." That is, IF the facts of the case truly are that he did not fire a weapon (which the jury found), what possible other reason could anyone have for anything other than an immediate vote to acquit?

Different jury.

The same jury that cleared him of opening fire on the officers, however, deadlocked on a charge of attempted murder -- and another jury found him guilty in January.

That jury was not allowed to hear that Morgan had been acquitted of the other charges.


If the defense tries to bring up the fact that he'd been acquitted of the other charges, I'm sure the person who brought it up would be found in contempt of court and the jury ordered to ignore that fact.

/honestly surprised this case of an almost summary execution for Existing While Black and subsequent conviction in court with a possible 80 year sentence doesn't somehow involve the NYPD

I'd still do it. I'd demand the judge explain why previously being found innocent of firing the weapon was not valid for this case. You'd probably get thrown in jail because the prosecution wants a conviction and isn't going to tolerate facts, but the seed of doubt gets put into the jury. That's all you need.

It does sound like key evidence was withheld. The attorneys responsible for that should face penalties.

If I remember correctly from another article, the jury wasn't informed of the other charges, so they were just deciding on that charge alone.

All of the articles I read repeat basically the same blurb. Not knowing anything about the prior prosecution, I'll guess that the aggravated discharge of a weapon charge has elements beyond just firing a weapon. It could very well be that, in acquitting on that count, the jury did not necessarily find that Morgan did not discharge his weapon.

It's because this case is harder for people to pander to. There isn't a juicy child-murder, anti-gun angle going on. And it's Chicago, this kind of behavior is the norm for the police.

That's all I've been able to find too. One blog run by a cop has a VERY different story of the events, but much like the other articles, nothing concrete is cited just throwing `facts' out there.

That jury was not allowed to hear that Morgan had been acquitted of the other charges.

Howard Morgan's van was crushed and destroyed without notice or cause before any forensic investigation could be done.

Howard Morgan was never tested for gun residue to confirm if he even fired a weapon on the morning in question.

The State never produced the actual bullet proof vest worn by one of the officers who claimed to have allegedly taken a shot directly into the vest on the morning in question. The State only produced a replica.

I know an nearly identical incident was covered in one of Malcolm Gladwell's books, probably Blink. The problem was that four white cops in a black part of town were looking for trouble and when they found it or something they thought looked like it they responded to peer pressure and fired until they ran out of bullets.

That being said... 28 bullets, this man could make his way in rap.

No, the second trial amounted to what always happens when the jury is deadlocked. A retrial. You don't get declared innocent just because the jury couldn't make up their mind.

It might be. If he pulled the gun and attempted to fire, but was stopped before getting off a shot, that might count.
