Prosecutors allege that Barrett met the victim,Jack Koency of Laguna Niguel, years ago,but after a falling apart, the pair reconnected about a week before Koency's death.

During its investigation, the Orange County Sheriff's Department discovered a motion-activated camera that allegedly captured Barrett "crushing the medication, mixing it in the yogurt and providing it to Koency"

The guy was dying and still hadn't got over the grudge that drove them apart, so he had her help him commit suicide, knowing the camera would capture the whole thing. He gets to end it and he finally gets payback on the grudge

Is it just me, or does this sound like the plot of a really bad crime drama?

Hmmm, I wonder how many of my meds I can crush into yogurt or applesauce. They aren't going down as easily lately, would be nice to not have to choke on them every morning. Or maybe I can get gummy vicodins?

If they consider it a crime why do they call it assisted suicide?I mean if your POV is that it's a crime why not say she was arrested on charges of murder?

You would have to ask the legislators who make the laws. California Penal Code ss. 401 provides that, "Every person who deliberately aids, or advises, or encourages another to commit suicide, is guilty of a felony."

Assisted suicide laws vary considerably by state. (Five states and D.C. observe common law, but have other provisions in place related to this. A few other states have no settled law on the matter.) These laws are often very complicated, so it's not easy to lay out, or even to compare states. Where I live (Connecticut), the State provides a 'DNR' (Do Not Resuscitate) allowance, which permits a person to voluntarily decline lifesaving measures ahead of time. Where I used to live (Rhode Island), there were similar provisions in place. Most States afford legal next-of-kin (or legally affirmed equivalent, through instruments such as certain Powers of Attorney) to "pull the plug" in some cases. (I believe Connecticut also allows such a person to enforce DNR, though I'm not sure if they can do so without an explicit DNR instrument.)

The main reason for these provisions is that either a majority of legislators or their participating constituents (those few citizens who bother to contact and communicate with their elected representatives) feel that the 'sanctity of life' is paramount, and should not be vulnerable to suicide. Many people feel that suicide devalues human life generally. (The Roman Catholic Church strictly forbids it, in all cases.) More than a few others also fear that assisted suicide opens the door to subtle forms of murder, including by persons seeking to gain from the 'suicide' of another. There are many issues, and it's all very sensitive and controversial.

From the POV of the law in most States, "assisted suicide," because it has the direct effect of deliberately and knowingly ending another human being's life, has a criminal value similar to murder or manslaughter.

I think a number of people in this thread are unclear on the concept of how the law views suicide generally, and assisted suicide specifically. It's not actually "okay" to kill yourself, or help someone else do it. I'm not saying I necessarily agree with that, but that's how the laws work. There are movements to change this, but right now, it's more or less the same now as it's been for decades prior. I'm aware that it's different in some other countries, but this is how it is here right now.

I can only speak for myself, but if the woman I love wanted to die, and needed my help, I'd be willing to go to jail over that.

The lesson from this? Don't be a pussy. If you are done with living, do it yourself. Don't have someone else do it for you so our farked up society will blame them.

That's what I want to know. I also don't like suicide, but if it came down to a choice of dying with dignity or dying with someone else wiping my butt, I'd rather die with dignity.

Even if it's illegal... a felony?

I give you a gun. You shoot yourself of your own free will. I have not shot you. I did not kill you. It should not be a crime.

On the other hand, if I know you're going to do this and give it anyway, that's still not murder. Shouldn't be a federal crime.

Aiding and abetting is when you assist some way in a crime. If you give someone a gun outside of a gas station, knowing they are going to rob it, you're aiding and abetting.

Not saying I agree with it, but that's the theory.
