This is why I don't like it when corporations have such a dramatic effect on our culture. Any terms that is used to describe their products tend to be trademarked and thus any publication except for criticism or parody are liable for lawsuit.

Eh?

Poke?

I was using "poke" on the Internets long before Facebook came into being.

Just ask Monster Cable how well such thinking worked out for them.

"Maybe I was being naïve, but I thought I could convince the lawyers at Facebook that our site was totally impossible to confuse with theirs," the Placebook site owner wrote in a blog.

You can convince the lawyers, but they'll still keep suing you. They don't care if they're right.

So I can't rap "write to myself on my facebook wall" without permission?

Wasn't the word "book" around way before Facebook.

I guess if you want to make a bet, you are going to have to call your "oddsie"

People were using the word "Facebook" before facebook.

Facebook is the most obnoxious thing to happen to the internet, with Twitter being a close second.

2012-03-24 10:15:47 PM
As I read it, this is part of their user agreement, not a part of trademark law. Thus, if you're not a user of facebook, you're golden!

I prefer the older finger (new window) command. As in "I fingered my girlfriend last night."

Good thing I never stepped foot on Facebook. Fark 'em.

And anyone that uses it but then biatches about the ToS? You can always get out and never use Facebook again.

Just release the IPO so it can crash in value and the world will see this billion dollar corporation for what it is.

2012-03-24 10:19:20 PM
I see Facebook's lawyers told them you can't trademark a number.

2012-03-24 10:21:22 PM
If I use the words face or book inappropriately, will I merely face a small fine, or will they throw the book at me?

2012-03-24 10:22:49 PM
That is just as stupid as someone trademarking NFSW and writing it on someone's face, in a book, on a wall, on a book that is part of the wall, on someone's face that is on a book which is literally a facebook on a wall.

/waiting for someone to trademark UFIA.

I wouldn't mind ditching the word "face" and using "ysight"

2012-03-24 10:24:56 PM
Good farking luck with that.

Next time try coming up with a name for your product/service that isn't a combination of common words.

You think Vitaminwater would have a valid claim against another drink product using vitamin or water in it's name?

No, so fark off.

A lot of people in this thread need to learn how copyright works.

They're not trademarking all uses of the word book. They're trademarking it for use in the name of a social media site. This stops other social media sites calling themselves ____Book. The copyright of wall also prevents other social media sites from calling a place where people can post on someones page a wall.

All other uses of wall and book outside of a social media website are still fair game.

aerojockey: I see Facebook's lawyers told them you can't trademark a number.

Which is not entirely true. You can't trademark any old number and prevent everyone from using it. But you can trademark a number particularly associated with your product and enforce it against other users who are creating a risk of confusion. Just ask Boeing. 737 anyone? 747? Porsche's 911--I wouldn't advise using 911 in your new car model name.

It wasn't even that. A facebook was just a directory that frats and societies are Harvard (and presumably other schools) put together for their membership. Harvard was trying to set up an online facebook and Zuckerberg thought it was taking too long so he set up his own.

I should have registered farcebook at some point while it was still available during that year I kept checking to see if it was still available. Now...it's already taken.

How about Farkbook? Let's have Drew and Zuck both sue me.

... what!? already taken!? fark....book....wall...

No. Suckerberg and megacorps are obnoxious.

I find FB useful for keeping in touch with friends who are far away, Twitter useful for following designers and photographers who post tips and other bits, Pinterest just kinda a cool distraction.

In concept, all are good. Greedy assholes are not.
