she failed to see the glass door at a Long Island location and smashed her face.

Isn't that something birds do?

Approaching the store, Paswall didn't realize she was heading straight for a wall of glass.
She smashed her face against it, breaking her nose

Oh come on. An entire store full of customers dicking around with cameras and no one happened to be pointing one outside when that happened? That would have been an awesome Tosh.o clip.

And how excited was she to get to the store that she was running fast enough to break her nose? I know she's old but damn.

How does someone hit their nose walking into a wall anyway?

at a Long Island location

Oh.

Well I think there's precedent here. In the case of Wile E. Coyote vs the Road Runner, the case of the Road Runner painting a false tunnel on the side of a mountain was thrown out.

It's not like she went all Zhora on the windows, but that would be fun to see.

2012-03-24 02:42:10 PM
She should spend money on new glasses before she buys anything else. That sharp new screen on the iPad is a waste of time if you can't see a glass wall six inches in front of your face.

She's a former furrier from long Island.

The nose she broke was custom and expensive.

Shut. Up.

And give up your license too, because if you're walking into farking walls, I don't want you behind the wheel of a car, you old bat.

There are building code and OSHA requirements for marking galss doors and wall at appropriate heights with safety stickers, or whatever. If Apple's building was in compliance with whatever the rules are there, it's going to be hard for her to show negligence on their part.
If there was some requirement that wasn't met, or some moron removed a safety sticker, or something like that, she might have a case.

2012-03-24 03:41:13 PM
Certainly the handles on the doors were visible. Also, Apple tends to keep the doors open during favorable weather.

In the year 2000, people that hit their faces on a glass doors/windows laughed it off.

Maybe I'm wrong but I thought every automatic door around had to have the sign on it. Is that not the case or was it there and she just missed it?

If that was the case, we'd be reading a story about her plowing into it with her Cadillac.

I blame the farking lawyer for this sort of shiat.

fark lawyers. You can tell by the advertisements that it barely takes a pulse to be a lawyer and they come out and promise these rubes these huge payoffs and the bigger the company they sue, the larger they figure the settlement will be.

fark lawyers. And sorry about the 30 or so who are the honest ones.

I've actually done this. An apartment building I was moving into had floor-to-ceiling glass in the lobby, and didn't put the eye-level markers that should have been there. Started walking out towards my car and *wham*. Didn't break my nose, but pushed the bridge of my glasses into my face and left a nice gash (and later, a scar) on the bridge of my nose.

Two days later, a friend who was helping me move in did exactly the same thing. Broke a tooth and got the building management to pay for the dentist's bills.

Witnessed a few more incidents as well, before they finally put stickers up. I wonder how much they wound up paying out in injury claims before someone got wise.

Turns out that Apple store had normal doors. She just walked into a window.

Not these, but the iDoor 2 will include automatic sliding for opening and closing.

You know what a normal person does when they walk into a door?

They laugh.

Seriously. I walk really fast, faster than most automatic doors can respond. And most of the places are thrift stores so I just grin and bear it.

Of course, I know my thrifts well enough to know when a door isn't going move fast enough for my pace. Its an annoyance, but Food Lion didn't install very fast doors.

/Before they evacuated the Dallas market.

What was an old lady doing at an Apple store anyway?

Was the Packard-Bell store closed?

To be fair, if you were in your 80s its much more possible that running into a door like that might knock you on your ass. Falls are not good at that age.

I've taken out a couple of screen doors in my time, so I feel for her.

I expect she'll win provable damages and nothing more.

This. You might not know that an Apple Store's door is a piece of glass, but you might stop to look for a door when attempting to enter the store. This is why birds hit windows: they aren't familiar with the concept of windows.

It never fails to amaze me how one persons inattentiveness / lack of physical dexterity is somehow not their own fault in cases like this.

Agreed.
You would figure she's been around long enough to know better.

Then again, she walked into a window, so I guess she has the right IQ for the place she was going.
