I disagree. Judicial review and mandatory precedent are long-established legal concepts.

There's lots of things that aren't explicitly in the Constitution, but might as well be based upon jurisprudence. Here's one for you: the right to privacy. Even the most derptastic don't deny that it exists.

Rockefeller was a statist jackass who saddled New York with a colossal failburger of a Medicaid system that simultaneously provides shiatty health care while costing more than the next two biggest state Medicaid programs combined.

And then there were the simultaneously expensive, racist and useless Rockefeller drug laws, whose evil spawn continue nationwide to this day.

Worst governor the state ever had.


That's not the point. I agree that Rockefeller's ideas were mostly bad. But he was capable of expressing them like a gentleman, and compromising with those with whom he disagreed. He wasn't an ideologue. He wanted to fix stuff - he wasn't very good at it, but he tried. I guess I refer to him partly just because he's kind of the poster child of Grey Suit Republicans.
This all really has a lot to do with boomers. When they were young, the country moved to the left. As they started to age, it moved to the right.
In about a decade, they are going to start dying or becoming too senescent to vote. At that point, the GOP will undoubtedly change it's spots, as it has before, and adapt and survive. Realpolitik and what actually happens don't have much to do with the ideological cant in the long run.

So, the question becomes, why are you still associating yourself with a party that has given itself wholly over to religious fascists, misogynists, bigots and racists?

Maybe he thinks he can change it. He's old enough to remember Goldwater and Rockefeller et al, and a time when the face of the Republican party wasn't Alfred E. Newman's. Perhaps he believes he can restore the GOP somehow, some way. Seems Quixotic to me, but I'm not going to tell that little ant to give up on that rubber tree plant. People like him enrich the world.

Well, good luck to him if that's the case, but the task seems more Sisyphean than Quixotic, to me...


I submit that it would be more Herculean in an Augean stables sense.

Scott Brown is a right wing douche, not some interesting independent. He talks a mean middle, independent moderate game and then turns and votes upwards of 90% with his caucus. He ain't a moderate Republican, he was way to the right of Snowe.

And he's gonna get his ass kicked in Nov.

You know, Scott Brown is leading Elizabeth Warren in polls by 7% right now, right?

The latest poll (PPP) 2 day ago is Warren +5


First of all, it's much too early for the polls to indicate much about what will happen in November. It's March. The distance between now and November is practically an eternity in terms of polling.

Mitt Romney as the Republican nominee could perhaps drive GOP some enthusiasm relative to the other blue states, but I'm not sure if this will have as much of an effect as you might expect. Republican party registration is down from the 2008 Republican race in MA (it has dropped by about 200 for the Democrats, and unaffiliated voters are up.) But the total primary participation numbers in MA (it's open to unaffiliated voters, not just Republicans) are interesting and I think indicate something about how the MA electorate is leaning this year.

2012: 367,438 (Landslide R-Money victory at 72%)

2008: 499,108 (in a year where there was much less attention to the GOP race relative to the Democratic one, although to be fair, also a hotter contest between Romney and McCain in MA.)

Looking at some other numbers, voter turnout in the general in 08 in MA was 62.1% and in the 2010 special election, 54%, which is pretty good. Scott Brown won by getting similar votes to McCain's in 08 (1,168,178 to McCain's 1,108,854) and looking back at previous presidential and Senate races in MA, around a million votes is a typical Republican outcome over the past decade. The Democratic numbers are quite different. Martha Coakley got 1,060,861 compared to Barack Obama's 1,904,097 in 08, and typical Democratic Presidential and Senate results range from 1.6 million (Al Gore) to 1.9 million (around the usual level for Teddy Kennedy and John Kerry.) This does lead credence to the idea that a) Coakley was a crappy candidate and b) Democrats were significantly disenchanted with Obama's perceived shift away from progressive values and stayed away from the polls in what was a highly anomalous election for Massachusetts.

Scott Brown does have incumbent advantage, but Elizabeth Warren is St. Progressive of Economics and Barack Obama has increased his appeal to his base since 2010 and he is going to benefit from their re-invigoration, mostly due to not trying to paint all women as whores who can't make decisions and need politicians to continually monitor the status of their reproductive organs. I think Warren will probably win this one.

Um, the deadline to ratify the ERA was in 1979, then moved to 1982. Both deadlines have passed, and the rationales of the paper positing that further state ratifications would simply add to the total from 1979 (and that the rescinded approvals aren't legal) are, at best, extremely dodgy and unlikely to pass USSC examination. Especially since the USSC has explicitly stated that the rescinded approvals are legal.

Basically, this is a pretty useless cause to throw your money at. To do this legitimately would require re-introducing the amendment to congress, not what they're actually trying to do.

//I guess I agree with the general "don't vote GOP" sentiment, though.

Sorry, the recent spat of derp from conservatives has left me thinking of republican's relationship with the women of this country (and men come to think of it) as being like an abusive boyfriend.

Come voting season, we we'll hear how the Republicans have done a lot of nasty things, "Except for my representative! He's a great guy!"

And the Democrats aren't prize winners either, but the Republicans have been especially anti-American for the past 3 years.

They actually make me feel a bit bad for my marriage. My husband and I certainly love each other, but I've been really kind of lazing out on my half of the chores. These remind me that I could step up a little and actually finish the damn dishes when I say I will. :P

In other words, sometimes you can go TOO far in the other direction. :)

I'm guessing this is the same mindset that calls Social Security a "handout," even though I've been paying for it every week since my 16th birthday.
