If the worst of excesses goes unprosecuted, of what use are those laws and what deterrent effect do they have? Can they even be considered to be the law?

You're right, he didn't make war like Bush. Bush got authority to make war from Congress.

Why it's worse is because not only did he not repudiate the theories of the unitary executive, he has effectively enshrined them into the powers of the office. This due to the fact that both parties in both other branches have ratified this behavior so courts are not going to tread here. Everything you don't like about the Patriot Act, or warrantless wiretapping or what database the NSA is building from domestic communications are effectively settled as matters of law, and no court is going to review them unless and until someone with direct knowledge spills exactly what's how there being used.
