IANAL, but the info provided upthread about CA's anti-spam act would not seem to apply to this situation. If it is a press release, it isn't actually trying to sell you something and it doesn't seem to fit any of the categories listed.

(a) No person or entity conducting business in this state shall electronically mail (e-mail) or cause to be e-mailed documents containing unsolicited advertising material for the lease, sale, rental, gift offer, or other disposition of any realty, goods, services, or extension of credit unless that person or entity establishes a toll-free telephone number or valid sender operated return e-mail address that the recipient of the unsolicited documents may call or e-mail to notify the sender not to e-mail any further unsolicited documents.

Any lawyers know whether a "press release" would qualify here?

Now here is where the pussification of America really stands out.

In the past, and if I knew this guy, we'd take him outside and beat the piss out of him. Really work him over, beat his kidneys into a pulp so he pisses blood for a month, break a couple fingers or an arm (especially if he's all gung-ho about darts), and tell him to quit wasting everyone's time.


Guarantee you he'd STFU quick. And those of you saying "He'd just sue you!" should know that he wouldn't even know who his attackers are. And when the police ask him, "Well Mr. Cocksucker, do you have any enemies that would do this?" the list he could spout off would end the investigation right there.

Basically, any mailing list has to have a simple (one link or one email) way to opt out. They have 10 business days to remove you. You can't charge a fee or require identifying information beyond an email.

If they fail to do that, they can face fines and penalties up to $16,000 PER VIOLATION.

And that's just for spam. Harassment can fall into a whole other category with new penalties that could be levied. I'm not a lawyer, but I don't think their 'this might be the email of someone we have a right to send legal notice to' would hold up any longer than it took the judge to stop laughing. If they haven't removed you after 10 days from when you first sent them the notification it sounds like they are in breach.

I didn't read the release in detail, but.. probably not.

I wonder if that would work...in this case, the guy realized that the real association allowed its corporate status to laspe in the late 1970s, so he re-incorporated it anew. And then he was a dickbag and sued the association and its board members for operating illegally (or some such).


I don't knwo the particulars of this story since I was only skimming the comments but you should know that Rex' lack of knowledge about trademarks is glaring.
