When the story first came out, I sent the guy an email telling him how childish he was being. Well, I then got put on an email distribution list for his "press releases". I asked twice to be taken off of it, and now this is the latest "press release". I am so honored to be so important to this douchnozzle.

GLENDALE, CALIF. March 21, 2012 - We recently received a demand from an unidentified
person who can only be described as Trivia Jockey triv­ia­jockey[nospam-﹫-backwards]l­iamg­*c­om who wanted to have
his/her e-mail address removed from our press release list.

The following is Southern California Darts Association, Inc.'s response to this person:

Dear Mr., Mrs., or Ms.:

We cannot properly address you because you, like most of the defendants and prospective
defendants, for example, George Spelvin g­e­o­r­ge­s­pelvin3­2[nospam-﹫-backwards]liamg*c­o­m (a.k.a. L. David
Irete), cowardly hide behind fictitious display names and never reveal your true identities, so
that we can do our due diligence and distinguish your hate rhetoric and vitriol with that of a
defendant.

Since you have interjected yourself into this lawsuit with nasty and hateful e-mails, we can only
infer that you are a defendant that is currently involved in the lawsuit or will be shortly. In
addition, based on your comments, we can infer that you are a member of this group that
continues to cause damage to our company, and thus, based on a recent lawsuit filed in federal
court by your entire group against Southern California Darts Association, Inc. and our
companies' president and CEO, we are within our rights to provide notice to you and every other
person who is involved.

If you wish to come out from the shadows and provide us with your true name, so that our
investigators can eliminate you from being involved with this bitter group of individuals, we can
see to it that if you are not involved and you do not continue to spew offensive comments
regarding our company or its personnel, or either one or both of these lawsuits, we most
definitely will remove your e-mail address from our press release list.

Thank you for your understanding and cooperation.

Can you look on the site for the 'Terms and Conditions' link and see if there is language about unsubscribing to the list? Also, look for their site's Terms of Service (ToS) and see if they say anything about email lists, or subscribing?
Additionally, how is it legal that you were added to the list when all you did was email an opposing viewpoint?

I wonder if that would work...in this case, the guy realized that the real association allowed its corporate status to laspe in the late 1970s, so he re-incorporated it anew. And then he was a dickbag and sued the association and its board members for operating illegally (or some such).

Tell them to talk to a trademark attorney or something. He may have the corporate status to lapse, but he's essentially usurping goodwill that has been established for 50 years in the geographic area of the darts association.

Again, not legal advice, just two cents from a disinterested bystander. Nothing I say creates an attorney-client relationship between the two of us. I provide any information with the caveat that it is only to the best of my knowledge and only for informational purposes, etc.

Under the anti-SPAM laws, emailing an address is enough justification for them to call you a "business contact" and start spamming you - until you request to be taken off their list. I believe California even requires they have a standard way of doing it on a web site.

BRINGING A BASELESS LAWSUIT RESULTS IN HEAVY COSTS

GLENDALE, CALIF. February 9, 2012 - Defendant, William F. Lynch in the action entitled
Southern California Darts Association, Inc. v. L. David Irete, et al. found out the hard way that
bringing a baseless lawsuit results in heavy costs; $4,935.00 to be exact.

Self-proclaimed successful musician, Lynch was quoted by Chris Vogel in a LA Weekly article
that ran from February 3-9, 2012, in Volume 34, No. II, and on www.laweekly.com, that "... he
was furious that Zaffina was effectively destroying his beloved darts club." Lynch continued to
prattle, he informed Vogel that, "He had plenty of money to hire attorneys and go toe-to-toe
with Zaffina in court...." [LA Weekly Article, Ibid.].

No where in Vogel's smear campaign against SCDA and Mr. Zaffina did Lynch mention that it
was he and/or other members of the club that "destroyed" the organization in 1977 when "those"
members forced the California Franchise Tax Board ("FTB") to strip them of their powers,
rights, and privileges.

Lynch would rather blame the "legal" SCDA or Mr. Zaffina instead of the club's incompetence
in committing some violation that required the FTB to step in on March 1, 1977, and put a stop
to Southern California Darts Association, Inc. for the next 33+ years, until Mr. Zaffina saved the
organization by bringing the corporate entity legal again on January 3, 2011.

Vogel writes, "Lynch and his lawyer, Michael Zuk, went so far as to file a cross-complaint
against Zaffina, essentially accusing him of blackmail. A judge, however, struck it down,
ruling that there was 'no conclusive evidence of extortion.'" [LA Weekly Article, Ibid.]. And,
that the law is palpably clear that everything Mr. Zaffina was doing on behalf of SCDA
was "protected speech" under the U.S. and CA Constitution. The "checks" speak for
themselves.

Guy joins for-fun tavern darts league. When his name goes on the website for a top score, he demands they include his middle initial. They kind of blow off the request, believing it to be silly. Guy then gets madder, looks and discovers that the dart league's corporate status lapsed years ago. He re-incorporates it himself, and sues the former league and all its members.

After reading the story, I emailed him to call him immature and a jerk. I get put on this email list for "press releases". He issued a new one naming me personally when I asked to be taken off the distribution list.
