"Will you demonstrate this for the court?"

A police thug hassling a citizen participating in a Pride parade? How surprising.

Last year, I went to the Atlanta Pride Parade and received the same ridiculing treatment over my outfit. I was wearing four inch heels, a tiara, and a leather sock that completely covered my genitalia. It was my way of showing support for my people's way of life. I hadn't marched two blocks before the police pulled me over to the side and said that I indecent. They roughed me up as they cuffed me and I accidentally lost my balance and fell into one of the officers. He took it as aggression and responded by beating with his nightstick. As he was assaulting me, my leather sock was torn off, exposing my penis and testicles. A police dog lunged and bit me, tearing my scrotum.

The refused me medical treatment and instead took me to jail. They through me into a packed holding cell, completely naked, with dozens of maniacs. There, I was sexually assaulted multiple times as they authorities looked on and laughed. That part wasn't so bad, though. Sort of like throwing the rabbit into the briar patch.

I'm sick of reading stories like this, but hopefully the press will lead to reform and better treatment of revelers.

Do you really mean that?

He wasn't just wearing the loincloth, he had a thong on under it.

I don't understand why he couldn't read the citation, but normally telling the cops yo won't sign isn;t the way to go.

Assuming the outfit shown is the one he was actually wearing during the incident, this is pretty obviously an instance of "putting the queer in his place." I hope the guy gets a large enough settlement to retire.

2012-03-14 08:51:57 AM
He should damned well have been allowed to read the citation. You want to read the stuff that you sign.

I'm kinda on the borderline on this. The loincloth covers the naughty bits when at rest, but there could be some wardrobe malfunctions if he were in motion. And although there are NO allegations of this ITFA, the flashing opportunities with a loincloth are, er, fabulous.

He should take this to court, and he'll likely win. It's a silly, arbitrary act of harassment and someone needs to be called out on it.

Pretty much. Not that I really give a damn about what a dude wears, but if females can get away with wearing clothes that are tight enough to see nips and camel toe and are barely large enough to cover both, dudes can wear the equivalent. And really... if someone expected to not see something like that at a pride parade, they are freakin' dumb.

(About ten years ago, here in Philly, the local cops harassed and abused the first openly gay member of the PPD to the point that he blew his brains while sitting in his patrol car.)

Agreed. Myself, I'm for letting your freak flag fly. Especially if it's for a festival where people would know what they were likely to see. But I could see some concern by authorities that the garment could be used in a lascivious display of waggling. I think everyone is happy that it was that guy, who is totally pulling the look off, but rules can be rules. And it sounds like he got a bad deal from the PD as well. There's no reason to lock someone up for this.

Reading the citation isn't the point. The only thing you are signing is the promise to appear which typically reads something like:

"WITHOUT ADMITTING GUILT I PROMISE TO APPEAR AT THE TIME AND PLACE INDICATED."

You really have only two choices at that point

1. Sign it and be released on your promise.
2. Don't sign it and go to jail until you can go in front of a judge/magistrate and make arrangements to appear.

When is the court date for your lawsuit? The Atlanta PD just paid out a cool $1 million over the illegal raid of a gay bar a few years ago.

I'm not so sure it's homophobia as much as just homo-ignorant. Sort of like when someone meets a gay couple and says "Well, you just have to meet my friends because they're gay too!" as if they'd be instant besties merely because they share the same sexual orientation. It's the same thing as someone assuming that someone who is gay will have gay sex with anyone, even if it means being assaulted and raped, though not nearly as offensive.

Loin cloths generally, do not. Ergo, just because he's wearing a harness =/= BDSM

Well, at the end, he was also wearing handcuffs and was in a cage. That's pretty BDSM-y.

JackieRabbit: rudemix: This dude sounds all butthurt

So would you if you had to spend time in the San Diego jail because of some homophobic POS cop. Your butt would hurt all the way to the bank after you won your law suit. Then it would feel so goooooooood.

Yes, I'm sure he will be set for life from the copious amounts of money he receives from his Wrongful Annoyance suit.

His lawyer is asking for $150K in damages and the judge may impose punitive damages as well. No, he won't be set for life, but he will get a pretty payout. The cop should be terminated as well.

I think killing a cop for being a homophobia asshole is a little harsh, don't you?

I didn't see the bolded info in the article but I did see this 'The case was never prosecuted'. Nothing in that article shows the cop acted because of homophobia or in an over the line manner, or breached authority. Can you and I believe he is a typical POS cop and a homophobe? Yes. Will it change anything in court? No. Sadly this cop has all the stop gaps in place for CYA. The cop made a call that he thought the outfit was bordering on illegal. He writes a citation to send it to court for a judge to decide. Guy refuses to sign, goes to jail. The outfit was the cause of the citation according to the cop, charge was dropped by court which is how that normally works. The arrest came from refusing to sign the citation. Bullshiat or not it's the law. Within the letter of the law the cop will slide in court.

As far as my own opinion I don't like cops. I also don't like people that want to litigate their causes, or perceived reasons they are being oppressed. I suppose it will all work out for the best if he wins and uses the money to advance his cause, and to help other people who have suffered as badly as he has. Or just spends it on whatever. But 150K spends fast. Not as fast as the life altering, mind changing, psychological damage as 12 hours in jail, though. The 150K will be gone (most to the lawyer who probably gives two shiats about this client) and he'll still have to live the rest of his life with the horror of the memories of his 12 hours in jail where people were rude to him.

AbbeySomeone: spentmiles: A police thug hassling a citizen participating in a Pride parade?

LOL!

Don't mind the homosexuals, just do they have to so gay about it?

Leather thongs and loincloth, really? That is sort of close to the fashion edge in any situation.

The arrest was *not* for failing to sign the citation, the citation is a form of deferred arrest, they are issued in lieu of booking. It's an either or question, either you sign a promise to appear in lieu of booking (citation) or you are booked the old fashioned way. He wasn't arrested for not signing, by not signing he chose to be physically detained until he could come before a judge.

I think the cop is a shiathead who should have explained what he was asking the guy to sign, and that the guy is probably your typical overly entitled whitebread guy who thinks that you can argue yourself out of a ticket.

I think the larger issue of whether or not that guy was doing something "obscene" merely by dressing scantily will be decided in Conan the Vegetarians favor and that it's pretty gay that it was ever an issue in the first place.

While we're at it, you are aware of some of the "costumes" your namesake wore in the E.R. Burroughs novels? No? Cuz they were really gay.

Yes - but he was chiseled ...and dated the hot Martian..and it was really warm on Mars...and all his other clothes were at the cleaners...and his trousers got ripped in a sword fight (not the gay kind of sword fight)..oh hell, point taken

StrangeQ: rnatalie: Reading the citation isn't the point.

Which is bullshiat, because it gives the pigs the authority to screw with any person's life at any time they please and there is not a damn thing the person can do about it. fark the pigs.

How do you figure?

Balboa Park has more than just a large patch of grass to march in. Depending on what part of the park he was in at the time he could have been near one of the dozen or so museums, a theater, The San Diego Zoo, The Boy Scouts Outpost and may not have been in the pride parade zone.

If the loincloth was a$$less and he was near the Zoo or museums there would be just a few small kids there.

Beach attire should stay at the beach and most men in g-strings or nude are at Blacks beach and are not on PB or La Jolla beaches. Even g-stringed women are a rarity here.

There isn't a legal difference between beach attire or non beach attire. Either clothes are indecent or they are not.

It isn't going to hurt a kid to see some guy in a thong.

It's Folsom Street, and yah, that get-up would be considered very... mild at Folsom St.

The man is good-looking, decently dressed, and seems reasonably intelligent. If he wants to go to Folsom St. with me, I'll wear half of what he's wearing in that pic, and not only will I get away with it, there are a few SF police who will want a picture of us with them.

/Props SFPD, thanks for being cool and fun all these years.
