So...Dick Cheney is afraid to travel to...Canada...for fear of violent protest and, in Europe, he'd probably face worse protests and possibly arrest, depending on the country. Four years after George Bush's departure from the White House, you can barely get a national Republican candidate to even say his name.

In his defense, there has been open conversation at fairly high levels about whether he should be subject to arrest in Canada, too (albeit not all that seriously, yet). He's an admitted and proud war criminal per the Geneva Convention. If I ever saw him in my country, I'd consider him fair game for a citizen's arrest.

Two problems with that I'm afraid (although i agree that Canada's universal jurisdiction over war crimes would extend to Cheney. There is no legal obstacle.)

1) You don't have grounds to arrest him unless you see him break the law or he's running from the cops. Citizens arrest only works under these circumstances:

494. (1) Any one may arrest without warrant

(a) a person whom he finds committing an indictable offence; or
(b) a person who, on reasonable grounds, he believes

(i) has committed a criminal offence, and
(ii) is escaping from and freshly pursued by persons who have lawful authority to arrest that person.

2) You can't just arrest him... you'd have to find someone who would charge and prosecute him.
