GoldSpider: quickdraw: Since the airwaves are a sort of public trust the public has the right to remove someone from them in the name of the public good.

And pardon me if I don't particularly trust what busybody moralists across the political spectrum believe is in my best interest.

So its ok for you to express your morals but everyone else should just shut up about theirs?

SkinnyHead: Mad Tea Party: SkinnyHead: But even if the older girl was the target to the joke, why is it okay to joke about her getting pregnant in the stands of a ball game. Isn't Letterman insinuating that she is a slut? An insinuation can be just as defamatory as a direct comment.

It's legally okay because it's a joke that no one will confuse with a statement of fact. It may not be "okay" in terms of being in bad taste, but it's not defamation. He's a comedian on a late-night show. Which is why Rush is (retroactively) claiming that he was joking. The only thing stopping Fluke from having an open-and-shut defamation case is that his hateful garbage is so idiotic that it can be confused with comedy. Let that sink in.

I suggested that the 14 year old girl could have sued Letterman for intentional or negligent infliction of emotional distress. That's a different cause of action than defamation. And because the child is not a public figure, Letterman's joke is not constitutionally protected.

Oh, and to propagate another meme, Rush has had four wives, is childless, and is against birth control. Is it worth thinking about the relationship between those facts? I'm just asking questions here...

You suck at this - even Wikipedia says so.

The U.S. Supreme Court case Hustler v. Falwell involved an IIED claim brought by the evangelist Jerry Falwell against the publisher of Hustler Magazine for a parody ad that described Falwell as having lost his virginity to his mother in an outhouse. The Court ruled that the First Amendment protected such parodies of public figures from civil liability. (new window)

I have highlighted the flaw in your argument. Falwell was a public figure. The little girl was not a public figure. She did not become a limited purpose public figure by going to a Yankee game with her mother.

Fluke was a limited purpose public figure because she participated in Nancy Pelosi's publicity-stunt hearing and she went on TV to advocate her position on a matter of public controversy, before Limbaugh made his comments.

The last year has been an increasingly rancorous attack on women from the Republicans.

Companies will be more hesitant to market their products on his show and more importantly, I think he may have to dial the crazy down a notch or risk having this happen all over again. Let's be realistic, a large portion of his listeners tune in just for the crazy.

He's between a rock and a hard place. He's had to dial up the crazy since so many others have taken selling crazy to a whole new level. If he doesn't ratchet up the crazy he loses listeners, his ratings drop and he loses advertising revenue. If he continues with the bile and vitriol he runs the risk of alienating some of his advertisers and again is looking at losing revenue.

Rush has painted himself into corner. I hope he likes it there.

I admit I was not aware Fluke had asked to participate in the hearings. However whether the matter was of public interest vs a public controversy before Limbaugh's comments, is still in question, which casts doubt on the limited-purpose public figure argument as well. Both of these are questions of fact for a jury to decide.

I'M BEING SILENCED!!!! 111 one.. one .. eleventy

Limbaugh is as free as the rest of us to shout his stupidity from the street corners from the roof tops and get a fark handle and troll the politics tab .

He is not free of consequences for his speech , which is what the "right" feels is an entitlement for them alone and confuse as "Free Speech"

The "left " is free to exercise their free speech to contact his advertisers and voice their dislike of their association with Limbaugh and inform the advertisers that they will not use their products and inform other to do like wise .

The advertisers are free to dismiss the letters and continue to fund Rush Limbaugh's show or they are also as free to not to .

If all the advertisers withdraw Rush is free to fund his show himself till the money runs out then he is as I said earlier , free to shout at clouds and post troll comments on Fark and become a freeper and ditto head all day long .

A whole lot of freedom there .... Please point out the "attempt to silence" or the taking away of freedom?

I agree to a certain extent. The problem is that Rush provides a feedback mechanism by which people with hateful views come to believe that their views are both common and justified. Where before they might have shied away from expressing their more extreme views and might have been put in a position to question whether they were valid and beneficial, they now have an external voice supporting them and reassuring them that their hatred is not only valid but just and right.

SkinnyHead: cameroncrazy1984: Joking that an 18 year old person got pregnant from a baseball player when it obviously isn't true is not a "rape joke" and is not defamation.

Letterman's joke was about a 14 year old girl. The older sister was not at the Yankee game, so it could not have been about her. How do you think that the young girl felt when she got home from the ballgame to find out that Letterman was giggling on national TV about how she was raped in the stands?

But even if the older girl was the target to the joke, why is it okay to joke about her getting pregnant in the stands of a ball game. Isn't Letterman insinuating that she is a slut? An insinuation can be just as defamatory as a direct comment.

Either Letterman was joking about a 14 year old daughter getting raped in public or was joking that her older sister was such as slut that she would get knocked up in public. Either way, what Letterman said was far worse than what Limbaugh said.

And, Palin didn't sue, nobody boycotted his show, but they had the right to do so. In Limbaugh's case, he is getting his ass handed to him. What this really means is that most people don't align themselves with Limbaugh. Too farking bad for him, boo farking hoo.

5. If the local advertiser uses an agency, contact the agency, as well.Just ask the local business, if they use an agency.

It won't take many letters and phone calls to get their attention and
remind the station that the letters need to be placed in the station's
public file. (the public file is an FCC requirement)Local stations don't
get many local avails in Rush's show and many pay a huge fee to
Premiere to run the show.

If they start losing business because of that jackwagon, they will
raise hell with Premiere. If KFI in LA got a hundred letters with follow
up phone calls it would get their attention very quickly.

Premiere Networks is a wholly owned subsidiary of Clear Channel. That means the radio stations themselves (basically) own Rush Limbaugh. I don't know if I would want to bother with the local stations, I would go after the local advertisers.

Changing the station does nothing to remove him from the airwaves. He does nothing to help the nation. Is it so difficult for you to see this?

I did work in radio, so I know that there are alternatives to hearing his crap. Rush does nothing to make the world a better place. If you can't understand that then we dont have shiat to talk about.

Actually, changing the station has everything to do with getting him off the air. If enough people do it, he won't have the ratings, the advertisers and thus a show.

No, sorry...that is only part of the way to remove him. Folks that have common sense will complain to the FCC. They will complain to Armed Forces Network about him. They will chew out the national advertisers until those companies do not use Clear Channel AT ALL until Rush is gone.

They will complain to their local stations advertisers too, and refuse to use thier businesses until Rush is gone from the airwaves.

I am a third generation broadcaster. I am not just a little put off by Rush's antics, he makes me ill. What he does is NOT entertainment. What he does helps no one. What he does is make incredibly stupid people feel justified in their stupid beliefs and stupid actions.

If you don't understand this....

I understand it. If he's collecting money from the Armed Forces Network, I have a problem with it. Tax dollars are funding him then. Why in the hell should I or you pay for a cancer growth to get fatter? Cancer starves off good cells, allowing more cancer cells to take their place. Let Rush pay for his own cloning.

I'm going to repeat something RON PAUL just said on CNN when he was asked about this: Rush isn't sorry for what he said. He's sorry that he's lost some advertisers.

Quoted. For. Truth.

The defamation is a side issue. It's an important one, but it's a side issue. The main issue is: Mr. Limbaugh earns his money through hate speech against, among others, women. He keeps doing this because the (relatively) small number of people who listen to his program are loyal to his advertisers. Those sponsors make it possible for him to continue.

Spewing a three-day misogynist tirade towards a 30-year-old law student crossed a line, even for him. Enough people started saying -- ignoring this just encourages it. He lost sponsors, so he issued his phony "apology."

He and his lawyers may be a little worried about a defamation suit. But if he were really worried about it, he'd have scrubbed his website completely of the remarks. He hasn't -- they're still up. (http://www.rushlimbaugh.com/daily/2012/03/01/left_freaks_out_over_my_ fluke_remarks)

He's worried -- and rightly so -- about becoming so toxic that no sponsors will touch him.

2012-03-04 01:20:02 PM
Why should Rush ever apologize for anything? He's pretty much the same as any of his listeners: morbidly obese, limp dicked, adulterous, stupid and a traitorous un-American sack of s**t. Given that's what his mouth breather audience expects, who would he ever be apologizing to?

To actually issue a real apology, it requires you to be a man with a mild amount of honor. He is not. Pretty much like the monkeys who listen to him.

Although, come to think of it, Rush is exactly like to type of man that Jesus was, so I guess he is a great Christian.
